TN Renewal 3 years

Post Mon Aug 10, 2009 2:40 pm

I thought i did this yesterday but apparently my post is not available.

Here it goes
I have had 3 TN visas in the past no problems no issues, whatever the officer asked i informed him correctly. I have noticed if your honest you won't have a problem.

My question is that i am deciding to go for a 3 year Mgmt consulting visa instead of 1 year just so i don't have to do this every year. I read on some blogs that with Mgmt Consultants it can get tricky, they have given several reasons in my opinion all BS or made up.. but that's my opinion

However just curious if their is any reality to this?
I will have my TN letter + 5 years of experiance acutally make it 7 now+ Bachelors degree (US)+ Masters degree (US).

i am wondering if anyone can shed more light to this.
Thanks
Mo

So you work for a Firm, not on your own? Correct?

If so, the 3 year MC TN should be no problem.

CBP manual wrote:Management consultants provide services which are directed toward improving the managerial, operating, and economic performance of public and private entities by analyzing and resolving strategic and operating problems and thereby improving the entity’s goals, objectives, policies, strategies, administration, organization, and operation. Management consultants are usually independent contractors or employees of consulting firms under contracts to U.S. entities. They may be salaried employees of the U.S. entities to which they are providing services only when they are not assuming existing positions or filling newly created positions. As a salaried employee of such a U.S. entity, they may only fill supernumerary temporary positions. On the other hand, if the employer is a U.S. management consulting firm, the employee may be coming temporarily to fill a permanent position. Canadian or Mexican citizens may qualify as management consultants by holding a Baccalaureate or Licenciatura degree or by having five years of experience in a specialty related to the consulting agreement.

Thanks steven this all applies to me, i am a consultant, if i dont work i don't get paid, i don't get any 401k etc etc. If i take a Vacation it comes out of my own pocket

Its just that everytime a project ends a new one starts and its easy for me to tell someone a new project has started dunno if the border agent (officer) will understand this?

Between you me i never had any issues with any border agent they try to confuse you sometimes but i think they do it in order to confuse you just in case if your lying etc.

In my opinion they are extremely professional people. Yet to see one who is an ass
Thanks

If you work directly for a consulting company it shouldn't be a problem as it says in that quote from the CBP field manual. Where people get into trouble is going in to do a job which is actually management, not being a consultant. Or attempt to stretch "management consultant" to something that it's not.
