TN renewal - flying back from Europe

Postby vancaustinate » Fri May 29, 2009 8:17 am

I am currently working in the US and my TN status expires next August. I am going to Europe for work in July and I am wondering if I can renew my TN at the airport (likely Houston, Dallas or Chicago) on the way back so that I don't have to do a special trip to Canada for the renewal.

The HR person at work seems to think that I have to enter the US via Canada so I am trying to make sure that my interpretation of "any point of entry" is correct.

thanks.

Any Class A POE can do it (which includes all US international airports), doesn't have to be in Canada. Obviously the further away from Canada you are the less familiar they'll be with it, but they're all reading the same instructions.

Also don't forget that almost all the TN's coming from Canada are done at preclearance (ie. in the Canadian airport). So it's unlikely the folks in Chicago or Houston will have seen many TN's (not sure if this is a good or bad thing).

I have approximatly the same question, my wife is travelling to US from africa, and she will apply for TD VISA as my dependant.
s it better for her to go to Canada and then to US? or to directly to here and ask for TD when she will arrive?

thanks

It is probably a bad thing. The laws and regulations governing TN's are fairly complex and the fact that they don't see many applications is a drawback. It would be difficult to adjudicate such a permit if they are unfamiliar or don't know how the laws or regs should be applied. I recall one such story earlier this year at O'Hare and that fellow was denied.

Last year my husband was renewing his TN when returning from Europe. Had no problems. The flight was from Prague to New York. At NY airport he had to show to the officer the letter from the employer renewing his contract and copies of his degrees, got a TN for 3 years.

I once got a TN stamped for Employer A, as a visa[/b] sticker on my Canadian passport in US Consulate in Chennai, India.
Then another time flew into Chicago from India, with another employer B offer letter, and got a new TN issued there. It was a bit of a hassle in Chicago due to employer change.

I would reckon flying from Europe or Asia straight into JFK or IAD would be okay for applying for TN. Not sure about LAX or Chicago ORD airports though, being far away from Canada, as one poster above mentions.

Any airport in the US shouldn't be a problem, especially a big one. It's if you start applying at pre-clearance in Ireland or something like that where you may have a problem I think.
