Hi All,

I have a job offer for a full time engineering position at a company in the USA. I am Canadian, fresh out of undergrad, not married, no kids, not a property owner. After reading some threads on TN Status here, my understanding is that a full-time job offer (ie. not limited to 1 year in length) can still be used to apply for a TN (I realise the TN is only valid for one year and I would have to reapply each year). Is this true? Can I still get a TN? And if so, what should be employer put on the TN letter for length of employment? I'm thinking just the start date?

Any info is greatly appreciated!

Whether a job is short term contract, contract to perm, or permanent, we use the same type of TN letter. It says that the company is requesting TN status for a period of 1 year beginning on whatever the date is. I'm pretty sure that if your letter does not state the one year term, you will have a very hard time. The actual job offer does not have to be presented if you have the TN request letter, stating the exact job title, one year maximum term, job description, salary, hours per week, who he'll be reporting to, company overview, professional requirement for the job and how the applicant is a match, etc. etc. In the second year and years after, the letter is similar, but says "we wish to continue to employ Mr. Soandso for a period of one year. Also each letter states that Mr. Soandso understands the temporary nature of the TN status and that he will return to Canada if, at any time, employment ends or TN status in not granted (or something like that, don't have it handy).

Ok, this sounds good. Now I just need to get the company to sign off on the letter and agree that TN status is the route to take for me to legally work in the USA.
