TN Status holder, former F-1 student wants to live in US per

Postby jlynn on Tue Oct 14, 2008 11:42 am

I moved to the US on August of 2003 on a F-1 student visa. I finished school in June of 2007 and then worked as an intern for a year on OPT card. I am not working until June 09 on my TN status, however I want to move permenantly back to New York. What is the best process because a green card will take too long. I am looking to go back to school however should I just try to get back on F-1 status?

If you are moving permanetly to the US you need a green card, all other permits are to temporarily work in the us and the return home, another country. only exception is h1-b and l-1 permits.

I can't see a way you don't have to spend time in Canada. You could enter as a B-2 visitor in January, then leave and re-enter on your TN-1 in June. But as you've already been in the US six months this year and your status has expired you have to leave.
