TN Status - unexpectedly laid off....

Just found out that I will be laid off in two weeks. I am currently working in Massachusetts on TN status. Here are my questions:

1. Can I collect Massachusetts Unemployment if I move back (and file from) Canada? (I have worked here for several years and have qualify in all other aspects except I am not a permanent resident).....

2. If I can collect the Unemployment, then will I get the amounts that Massachusetts is paying out and for the number of weeks that Massachusetts is paying out (versus what Canadian UI is paying out?)

3. How does a POE officer know if I have been laid off on a TN status if I do not tell them? (for example, do they have access to unemployment records that would tell them that). Not wanting to start a debate about this, I am just wondering......

3. By turning in your I-94 to Cdn officer, you won't have to worry about that. You are not thinkinhg of lying, right?

I was laid off from my job in Ohio on 4 June 2010 for which I had TN status. I have moved back to Ontario and I have applied for unemployment through Ohio and I have been told that I may not qualify due to the fact that I am not currently authorized to work in the US. TN status tends to be voided upon termination of job but my I-94 card was valid through Sept 2012. I mentioned to them about the Unemployment Treaty between the US and Canada and they said that I have to be eligible to work in the US.
I have been on the phone with the Department of Labour and they are in talks with the Unemployment office from Ohio. I mentioned to both that I spoke with Service Canada and was informed that the I am suppose to get unemployment especially since it’s a reciprocal agreement and Canada pays out benefits to US citizens. They are telling that it can take weeks to get a determination from the customs office at Buffalo to see if in fact my visa allows me to collect unemployment. Is there anything else I can do to try and help the situation?? Any advice is greatly appreciated...

The important thing to do, as you have found out, is to co-ordinate your US UI claim through service canada. Once you do this, your right to UI, by showing that you have returned to canada, and are eligible for work there, will get you your UI.
