TN Tax form Resident or Non-Resident


I will be filing both my Canadian and US taxes this year, but am not sure what form I should be using filing in the US, is it the Non-Resident or the Resident form, I am on TN-Status and will be here ...

If your tax home is still Canada you essentially have to file 1040NR and Form 8833 (in addition to the T1). Not an easy form to fill out and the instructions are out-of-date because the treaty has changed, so when next year rolls around you will need to look them up or talk to the IRS.

You claim a foreign tax credit in Canada as it explains in the instructions for the T1.
