TN/TD income tax - How to file "correctly?"

Post Mon Jan 23, 2012 9:48 am

My wife and I are Canadians who live in the US and have been here for two years under TN/TD status.

I am employed by a US company. My wife is a self-employed consultant for a Canadian company but works remotely.

We are looking for advice on how to file income taxes this year and in the future. I realize that I probably haven’t provided enough information to answer sufficiently, but any advice is greatly appreciated.

Thanks!

done.

also, wife is concerned her situation may be perceived as "working in the US" when she is certainly not eligible to do so under TD. Is this a warranted concern?

Well, she is doing it, so her 'concern' seems to have limits.

Seriously, as long as the comapny she is working for has no US dealings, and neither she nor they are 'benefitting' from her physical presence in US (ie. she doesn't have access to resources where she is that she would not have in canada), she is fine.

Does that fact that she is not employed by the company (she is self-employed contractor) have any bearing on the situation?

If we are non tax residents of Canada, that means that she pays income tax to the IRS (and not Canada). That feels a lot like 'working in the US.'

I have a thread on serbinski if you'd prefer to have the discussion there.

Thanks, again

From an immigration perspective it makes very little difference.

Not really because you can be a tax resident without being an immigration resident. A tax resident has to pay tax on their world income to the country of tax residence regardless of immigration status. As you say a detailed discussion of the tax matters is best directed to serbinski.com.
