TN Visa, Accountant - Need Suggestion/Boder Interview

I am new to this great helpful site on TN and other visa issues.

I am ready to apply for TN visa under Accountant category. I have letter of job offer, with start and end dates, salary, and job description.

I have following education:

BBA degree, diploma in Accounting.

I need help with preparing for interaction with CBP officer at the border.

You don't hold a foreign degree, your BBA is a Canadian degree. The only equivalence permitted under NAFTA is to show that a foreign degree is equivalent to a U.S. or Canadian degree. Thus your evaluation is useless for all intensive purposes.

If your BBA is an honors Canadian degree in Accounting, your TN should be straightforward. Three-year programs from Canada, China, and India are not accepted for TN unless you have an extra year of high school but Free Trade Officers do accept them in error.

You don't require your resume, evaluation, or CPA exam letter.

Start and end dates on the letter are optional.

The 3-year bachelors degree from Canada must be accepted, by the terms of NAFTA. It's not an "error", it's a treaty right.

Only Non-US/Can/Mex degrees are subject to equivalency.

And the expression is "all intents and purposes".

Thank you everyone.

I got my TN visa.

I learned few things:

If you meet the TN-1 visa requirement, you get the visa - SIMPLE.

Port of entry does not matter, all officers are nice, may be there some exceptions.

Letter of offer has significant impact and should be addressed to CBP.

Better to go during business hours and weekday because they have more staff on hand and some with experienced to deal with TN.

See if you can think of the logic behind it. All Bachelor degrees including Canadian and foreign are always compared to a 4-year U.S. degree Program. The U.S. does not offer 3-Year Bachelor degree programs, only 4-year programs. Thus equivalency is always equated in comparison to a 4-year American University degree. So I know you have fought me many a time on this before, but a 3-year Canadian degree is not an eligible degree for TN, believe it or not.

By the way, I never pointed out all of your horrendous spelling errors either but I do try my best.

A Cdn bachelor's degree is uncontestible with respect to NAFTA TN -- as long as the Cdn University is accredited. This equivalency does not extend to other immigration process, LC, I-140, evn H1-B. But it most certainly does for NAFTA.

Typos is one thing -- who cares? You were using an incorrect phrase, based on how you've heard it pronounced, not how it is written, which I'm quite sure you will be glad to not be caught using in future, perhaps in a more embarrassing situation. You are now better off than this morning.

That does not embarrass me. After all, didn't someone on here tell you to get a life? I don't think there is anyone on this board that has not been embarrassed at one point or other. I would be even more embarrassed by being factually incorrect which I am not. I have had multiple legal sources verify the validity of it now so I am careful on this forum in misdirecting others in a potentially harmful and malicious way.

I guess the CBP officer are the best judge to assess the credentials.

I received this statement in writing and have stuck with this principle in all of my postings. I have had multiple legal sources confirm it now so I am careful not to misdirect others or give out reckless advice:


"Three year degrees from India etc are not accepted, but if you did Grade 13 and then got a 3 year bachelor's degree, you should be fine anywhere."

This is also consistent with how certain ports have handled 3-Year degree programs, in particular Rainbow Bridge, Niagara Falls, and Buffalo have flatly denied them regularly in the past.

Even Brian Zuccaro (a Buffalo based lawyer) admits 3-Year Bachelor degrees may be "problematic" at the border for TN:

That is the key. India is not Canada and not Mexico.

For all other purposes, Canada and India face the same standard that you mention, but not for NAFTA. That is the whole point of a treaty.
