TN visa and consulting

Hi,

Any advice in the following area is much appreciated.
Myself and my wife are on TN. Currently, my TN is held by a company A which provides client consulting services. My current project at client B is about to wind down as the end approaches.

My question is - If my project winds down sometime in Jul.. do I need to change my status back to TD or continue to work for company A. The company A pays me and holds my tn. The TN on my passport has company A's name on it. It does not have anything related to client B. There is not much info or clarification available on this topic. .

Please advise.

You need to be performing the work that got you your TN, or you are out of TN status, and should revert to TD by going to the border (or mailing an I-539).

Company A must find you another client in July to keep you on TN. They cannot "bench" you, keeping you on payroll -- fake or real -- without you doing actual work.

Thanks, changed it to TD.. Once I get another client project, I will need to switch from TD back to TN.. anyone know whether this done by canadian citizen at a US-mexican border? I'm in the southern states..

Southern border can handle all TNs. How did you switch to TD?

I have a question regarding TN visa with job changes - my current TN visa is not expired yet, while I changed my job with another employer, and plan to relocate from Tennessee to California. My plan is to get a new TN while I move my family to California first. But I was told that on my way from Tenn to California (if I drive there), I may get caught in New Mexico or Arizona since the border officers may check my TN visa/status. I would appreciate to have some information or insights in this regard. Thanks a lot!!

I have found my new consulting project and want to change back from TD to TN ...

From your previous answer, it seems US-Mexico handles TN visa cases for Canadian citizens.. I would prefer that..
Question: When I change from TD to TN, if for unknown reasons they do not grant tn.. will they allow me on td (since my spouse is still on active TN)..we have small kids and prefer not be left out in mexico...please advise..

Technically all POEs can handle TNs at time of entry into US. mexican border is one choice.

If you are denied TN only for problems with your petition, your TD will remain valid for re-entry.
