TN Visa and no job

Post Sun Sep 28, 2008 2:09 pm

I have recently lost my job and I am searching for a new one. I want to go back to Canada for a few days to do business then go back to the US to continue looking for work. Does anyone know if this will affect my TN Visa status entering back into the US? If so what can be done?

It's illegal to look for work in the US while you're in the US on TN-1 or as a B visitor.

In addition if you've already been in the US for at least six months this year they may not let you back in as a visitor.

You can attend a specific pre-arranged job interview as a B-1 visitor, the regs seem to say that you can't but plenty of people have done it (including me), i.e. people have specifically said to USCIS that is the reason they are entering.

If you no longer have your job obviously your TN-1 status is gone, if the stamp on your I-94 hasn't expired though I'm not sure how or if USCIS can determine that.

If you present your PP with an unexpired TN I-94 you are attempting to enter the US under TN status. If it is discovered by the CBP officer that you are no longer in that status and were attempting entry to return to a now unlawful residence you could face a 5 year bar from entry into the US without an appeal from a Judge,Decision is made by CBP officer and his Supervision. Not worth the risk. If your job is over go back home, apply for new jobs from canada, once you find new employer apply for a new TN status.

It just that easy.
