TN Visa and TD visa, spouse working?

Post Sun Oct 02, 2011 6:36 am

Hello,

A few questions about how getting a TN and TD visa work. I am planning on moving to the US to work as a physio mid-2012. I'm am familliar with the docs I need to apply for a TN visa and how that all works but am wondering more about applying for a TD visa for my husband (we are both Canadian).

1. Can he apply for a TD visa at the same time I am applying for my TN, as we cross the border?

My husband may not be able to get a TN visa himself (he is a teacher, certified to teach high school) though he has been employed by Manchester College this last year teaching in a juvie prison (we currently live in the UK) so may be able to work in a college in the US. However if he can't find that type of work:

2. Is there any other type of visa he would be able to apply for thats as simple at TN? Would it just have to be an H1B if it doesn't fit any of the NAFTA job descriptions?

3. Is there any type of visa you can get under your spouses TN that would allow part time work?

We don't intend to stay in the US more than 2-3 years. We own a home in Canada and would like to go back there eventually. Just want to live someplace else a while and do some travelling before settling down.

Thanks in advance!

Its better to consult that to the embassy or to the immigration office. They will provide the right information that you need about your problem and also ask an attorney that are expert in visa and immigration issue for the support information if your problem. In this way, you can get the information that you need.

Ignore previous post which is little better than spam.

1. Yes
2. h1-b
3. work can be part-time, but it does require his own TN.

TD is really a 2nd-class status, with no benefits. If your spouse is a professional, he should be looking for work and getting his own status as soon as he gets here.

That one is about as simple as it gets. Try my Visa Selector for the other "usual suspects" for Canadians: http://www.grasmick.com/discover.htm which may require more complexity. Also see my FAQ question "5. Can my spouse work . . .?" at http://www.grasmick.com/canimfaq.htm

>Is there any type of visa you can get under your spouse. . . that would allow part time work?

l-1 and E visas allow spousal employment.
