TN visa - At-will employement letter --- pls advice

TN visa - At-will employement letter --- pls advice

Hello all experts,
Fantastic/infromative site.
Ok, my situation:
I am Canadian, had TN visa last year (smooth process), changed employer, now to apply for new TN =D>
Problem #-o (maybe not!): This company does not have contract, it is At-will employement and the position is indefinitely with start date ofxx-xx until either parties with or without cause decide to call it off!
Company is in health care area with ties to federal/state Gov.
Is this a problem? Should I have "term" (-end date) for the job with "possible" renewal option in the employement letter?
Please advice -

Hi! I am definitely not an expert, but my boyfriend just got his TN visa and had everything looked over by a very good lawyer. She informed him that his 1 month contract would NOT be accepted because it was too short a term (when, in reality, it is simply a very short probationary period for a permanent job, at which point he will apply for either a different visa). The TNs are now issued for up to 3 months, as I'm sure you know, but must have a definite start and end date. Keep the agreement you have with your employer, but have them write up a letter stating that your employment is "up to" 1-3 years. "Possible renewal options" also seems like a good thing to put in there.

Again, I'm definitely not an expert, but have spent the last few weeks sifting through every piece of TN visa information I could find and would love to help!

Thanks for your input. I will ask for a letter with start-end date, I hope they agree to write the letter. Open emplyment letter is not uncommon in US as I researched, but it seems doesn't work in TN.
Any other input? pls :?:

You should have a start and end date, i think without the dates you won't be facilitated, you will be send back.

Had a similar letter from my employer, i.e, at-will employment with a start date and no end date. Went to the Alexandria boarder post, obtained 3 year TN1 visa without any problems. When back home and travelled the next day through Pearson airport to the USA. I don’t think you will have any problems without an end date.

Lucky01 = Thanks for the post, great yours went smooth.
how did you (incase officer asks, how would I) convince the officer the job is “temporary” and ends in 3 years?
Did you have to explain the situation?

I thought (with the advice on this site) I play safe and ask the employer to add the end date ( if they don't I then jump into the hot pot!) Thanks.

I had also prepared to play safe...I guess I was just fortunate; I presented the application package from the company immigration lawyers. The officer then asked for the originals of my certificates, which I presented. He then asked if I've ever visited the US, where I obtianed my degrees, what I do (my present job) and what I will be doing in the US...He then asked when my family will be joing me inteh US. I told hime within 4-6 monts. He said they should have a copy of my I-94A at their port of entry; and that was it...it took 16 mins... I drove back home and when to Pearson airport the next day.

I had prepared to tell the officer that if the company still wants me after three years I will acept, but I won't stay in the US for more that 6 year...fortunately he never asked...
