TN Visa...Biochemist and Chemist

Post Thu Jul 21, 2011 10:57 pm

Hello guys,

I will be applying for my first ever TN visa shortly, and am already getting confused and having sleepless nights about it.

My first question is that- I read Biochemistry upto the PhD level, and I got a job as a Research Chemist in Canada and have worked ther for over 2-yrs. Now, I have a job as a Chemist in the USA, and will be seeking a TN status with this job. Is it allowed to present a job title as a Chemist even though my degree certificate will be for Biochemist? Both occupations are on the NAFTA list.....is that a plus for me? Or it doesn't matter?

My last question is that do I need an employment letter and a letter addressed to Homeland security, or just the letter to DHS is good enough?

You need to apply for the TN category you will be working in, regardless of education. Then, your education (not your experience) must closely match the category you are applying under.

Is there much of a stretch between Chemist and Biochemist? I'm guessing not, since you work in either field.

They will check the job duties you describe against the DOL DOT (Dept of Labor Dictionary of Occupational Titles). They should mesh.

Again, your previous work experience is not used in determining if you are qualified for TN. Only the job duties and your education count.

Most job letters contain insufficient information for getting TN, so a true TN letter is always best.
