TN Visa - Consulting in Multiple Cities

Post Thu Aug 16, 2007 10:58 am

Hi,

I think I read every post on this forum without finding an answer to this question.

I will be employed by a US company to perform IT consulting 'System Analyst' work for their clients. These can be anywhere in the US. Would I need a new TN application everytime I change client site (potentially every few months?) I believe the TN application needs to specify in which city I will be working? And if the location needs to be specified on the application, would the city of the HQ be that location even if work can be done in other cities as well?

I will be travelling every week from Canada. Thanks.

I believe you only require the TN Visa for the company who you're actually on their payroll. So I'd assume that you're going to get paid directly from the IT Consulting firm, and not from the client.

The sponsoring company's main office is fine.

Yeap, you should be fine with just the one TN (you can only have one at a time anyhow). You're actually just working for one particular company, and its them who is contracting you out. As long as its just them who are cutting your paycheque, you're good to go.

Yes, as long as your visa is with the IT Consulting Firm - you have no issues with having the one visa.

Quick correction - you can hold multiple TN Visas at the same time with different employers. You have to apply for each visa separately. For example you could hold 2 part time jobs which both qualify for the TN Visa. You would have 2 TNs in this case.

I am in a similiar situation and very confused! I have a consulting business in Canada--I am getting serval responses per day on my web sight from the US--I would visit the organization for 1-2 day max and then completed the paperwork in Canada and respond via fax-e-mail. I need direction as to what I need to make this happen. The work visa does not appear to fit my need.

Thanks

You would need to either get a TN for each client, or engage the services of a professional agency, who would sponsor you once (for a fee of course) and then you woule work for these clients thru thte agency.

Hi

You may qualify for the B1 visa (business visitor).

Thank you and good luck!

Indeed. The fact that the poster continually lives in canada -- a dteail I had ignored -- rather than in US, makes B1 a more viable entry status. This would not be available to someone who has moved to US.

Hello,

going back to the first question asked with regards to being hired by an IT consulting firm and working for multiple clients, I was recently denied a TN visa stating that you can only work for the company that is hiring you and not be sub-contracted out to its clients.

Is there a change in this law now?

Thank you
