TN visa for part time worker

Post Sun Dec 13, 2009 10:15 pm

This may sound like a weird question but is it possible to get a TN visa for a part time job? Also would there be an issue if the pay for a job was less than the market average.

Thanks

Holding concurrent TN's is possible but only part-time employment is acceptable as determined by CBP. You could not hold two full-time jobs under TN. I doubt the prevailing wage level for just a part-time position would be an issue. However, you would have to be able to qualify for the job under NAFTA and hold the appropriate educational credentials to become authorized.

You can get a single TN for a part-time job -- in fact you have to. The question then becomes if they would accept that you move to US on such a meager wage.

Most CBP would insist on you maintaining residence in canada and commuting, or show other means of sustenance.

But a second TN for part-time job, coupled with your primary TN, no problem.

Thanks for the responses. My situation is more that I'm on a TN visa right now for a full time job. However, it looks like we need to move so my wife can work on an H1B visa and I may only be able to get a part time accounting job or an accounting job paying less than the prevailing wage. In the end we would be making more money than I make now so it makes sense from a financial perspective.

Then, as I said, your other financials would remove any doubt that you could support yourself.

You are fine.
