TN visa holder spouse

Post Fri Aug 19, 2011 5:33 pm

we are getting married in Ontario and we both Canadian Citizens and I have a valid TN visa at the moment. We are getting a quick ceremony in Canada to get our marriage license and do solemnize civil marriages in City hall. After that we can go to border and get my wife a new TD visa? Is that correct? There is also an Ontario Marriage Certification which seems it will takes few months to come. I just want to make sure that we don't need to wait for that.

The border officers will generally issue TD basesd on the copy of the certificate you get at the ceremony.

Hi, I am on a TN visa and living alone in the US.

My TN expires by December's end this year. My employer is renewing it for another year. But this time my 'fiance', of which there is no real legal definition wants to come and live with me.

It seems like the only options are:

1. for me to marry her and apply for a TD visa
2. To apply for a visitor visa (but then I don't have much of a footing in the US other than employment)

a K-1 is for fiances who are engaged to a US citizen.

My question is, what are my options for her to stay with me ? She has been here several times over a weekend and the border guards never really asked her when she'd be back. However I know that for a Canadian to visit the US and stay there long term is a violation of the law.

First off, SHE is the one that has to apply for anything, not you.

So HER choices, are to either marry you and enter on TD status, or not marry you and enter as a visitor "partner B2" status (requiring that SHE prove that she will maintain a residnce in Canada during the entire period of your TN status). This partnwer status will be issued for 6 months, but renewable as long as you are on TN.
