Hi

Im thinking about applying for my first TN visa. I went to University in the US and a friend from school wants to sponsor me through his business to come down on a temporary basis and help him build custom homes. My degree is a Bachelor of Science in Architectural Engineering Technology. Does anyone have any idea if this is an acceptable situation for a TN visa? NAFTA states that an Architect is required to have a "Baccalaureate or Licenciatura Degree; or state/provincial license". I believe my University degree is adequate for the NAFTA requirements. On the other hand, does the "Architect" actually have to be entering into a typical architecture design job or can it be a related field like construction development or project management.

I know very little about architecture but I would think a big test of whether your case is likely to succeed would be whether this job really requires your degree. Architects normally design homes; they don't build them--conversely the people who physically build homes do not usually have degrees in architecture.

It sounds like a stretch to me but it is hard to be sure.

Your employment letter has to state your job description. Generally they like it to fit into the dictionary of occupational titles. Here is the typical job description they'll be looking for:

TITLE(s): ARCHITECT (profess. & kin.)
Researches, plans, designs, and administers building projects for clients, applying knowledge of design, construction procedures, zoning and building codes, and building materials: Consults with client to determine functional and spatial requirements of new structure or renovation, and prepares information regarding design, specifications, materials, color, equipment, estimated costs, and construction time. Plans layout of project and integrates engineering elements into unified design for client review and approval. Prepares scale drawings and contract documents for building contractors. Represents client in obtaining bids and awarding construction contracts. Administers construction contracts and conducts periodic on-site observation of work during construction to monitor compliance with plans. May prepare operating and maintenance manuals, studies, and reports. May use computer-assisted design software and equipment to prepare project designs and plans. May direct activities of workers engaged in preparing drawings and specification documents.
