TN Visa Renewal Application and stay in the U.S. in process

Dear All:

My employer has applied for my TN renewal. The question I have is, can I legally stay & work in the U.S. while my application is in process?

Is your current TN still valid?

Yes, it is still valid. The process of renewal takes about 2-3 months I guess. So, by then it will expire.

Have your employer file the I-129 before your visa expires. Once your TN expires you have up to 240 days which you can stay in the country waiting for your renewal. At least that's how I understood it!

And make sure you do not leave the country until you receive the I-94 in the mail.
