Hello everyone!

I want to know if anyone knows about regulations for a TN.

I have been hired to work as a consultant in marketing for a company, the problem is that the they has sell one of their businesses that I was working for and now I work for the same employer but for a new company that they just created (doing the same job).

Do I have to re-apply for a new TN if the TN is under the same group name? and if that new business is under another new company name, , but has the same owners, do I have to re-apply?

And can we work someplace else as a part-time job? or gey another contract has second job?

I suggest you speak with the HR department. If they have other sponsored employees, they should be aware of what they need to do to keep them there legally.

As for other jobs, no I don't think you can legally seek other employment. You can only work for the company who first sponsored you for the TN.

I think Reba is right, if the company that writes your paycheck changes, they will need to obtain a copy of your I-94 and SSN to legally pay you, and this is where the computers in Washington may or may not correlate your TN employer to the person who is withholding your taxes. It is not worth the risk. It could be USCBP does not record the TN sponsor in a way that is not computer matchable, but that is a big chance to take.

You definitely cannot take any side jobs what so ever.

Oh, one other thing, I am not sure what kind of consultant you are being hired as, but some kinds of consultants are only permitted to perform certain functions. You won't want to call your title simply consultant in your offer letter.

Hi

You will need to reapply if you work under a different company name. Simple rule of thumb is - the company listed on your visa, should be the same as the company listed on your paycheck.

Also, Mark's concern about consultants is very valid. Be careful of the job title and job description you use on your TN visa application - if it's different than the NAFTA Occupation title, remember to show how it applies to the NAFTA occupation.
