TN Visa without a degree.

Post Mon Oct 11, 2010 9:31 pm

So I have a job offer by an IndyCar team to work in the US. I will be applying for my TN as a "Scientific Technician" in the "Engineering" field of study. I myself do not have a degree which is actually quite common with racing engineers/technicians, but I will be working under an engineer with a degree. My question is, when I apply and state I will be working under a engineer with a degree, do I need a copy of their degree or something to prove it?

Also I am bringing a letter from the employer stating how I qualify for the visa and the job, maybe some articles about the team, and setup sheets for the cars to show the incredible amount of engineering that actually goes on. Should I, or do I need anything else? The forms I will be filling out will only be once accepted, correct?

Yes, one typically needs to provide the qualifications of the person you will be working for to get a SciTech TN.

There are no "forms" for border TN.

Hi
Here is an official description of a Scientifc Technician's role:
"Science technicians use the principles and theories of science and mathematics to assist in research and development and to help invent and improve products and processes. However, their jobs are more practically oriented than those of scientists. Technicians set up, operate, and maintain laboratory instruments, monitor experiments, make observations, calculate and record results, and often develop conclusions."

Look at your job duties and determine if they are in line with this. Supporting documentation is very important to show the Immigration Officer the job qualifies under NAFTA and that your skills do as well.

Good Luck!

Sincerely,

This is a viable occupation under the Scientific Technician category. A degree is not a mandatory requirement for this category. However, you will need to prove you are reporting to a degreed Engineer by supplying the applicable educational credentials to CBP at the port of entry.

However, there is a good chance you will be refused entry as the DHS many years ago implemented educational directives for this category. An education of at least 2 years in duration is now a mandatory prerequisite for obtaining a Scientific Technician TN.

Unless you can prove you have the 2 years of college, you will be turned back to Canada. If you don't have the education, forget it.

Incidentally, this very real danger of being denied entry was not pointed out by either Nelson or TN Visa Expert.

I dodn't mention it because it was just that -- incidental to the question asked.

Sorry I didn't respond until now, I appreciate all the responses. The job is just being delayed right now until funding for next season is confirmed.

I do not have 2 years of college education. I went to a racing school for 1 year where I studied mechanics and race car dynamics. I also have 3 years experience working as the lead technician on open wheel race cars. Will that still qualify me for the visa?

Without diploma you are ineligible for TN under the category you are likely seeking, and I don't see any other category that would fit.

The firm would need to get a lawyer to see if they could bring you down on a more permanent immigrant visa, or perhaps extraordinary ability, but that is not a discussion for this travel advice site.

I wanted to let you guys know I received my TN Visa today with almost no problems. The only thing the officer said was that I should look into getting a replacement certificate from the racing school I went to so I actually have proof I went there. I misplaced mine...I might find it but would have to do a lot of digging. No lawyer was involved so the grand total for my TN was $56.

Under what category were you granted TN? Was it Scientific Tech?
