TN without Sponsor

Hi,

I want to look for a job as an Actuary Analyst in the US but lots of company say they don't offer sponsorship, so I was just wondering if people can apply for TN1 on their own if a company that doesn't offer sponsorship give them a job offer. One of the company already work on it's website that they don't do any sponsor even for non-immigration work permit or temporary work permit.

It is not possible to apply for your own TN unless you own and run your own business in Canada that is linked to a company in the U.S.

Without a job offer, you will not be able to gain a TN. Also an Actuary Analyst is not one of the jobs listed under NAFTA. A lot of companies are reluctant to hire foreigners unless there is a dire need, and this is due to the recession.

But I say keep looking and maybe a company will sponsor you for an H1B.

No, this is not possible. A TN is tied to a specific employer; thus you must have an employer willing to hire you in order to get a TN.

Also, you cannot be self-employed while on a TN.

No, self-employment on TN-1 is not legal, doesn't matter how complex you make it (e.g. Canadian corp with a US office hiring you, etc.), if it's not arm's length, it's considered self-employment.

One of the company already work on it's website that they don't do any sponsor even for non-immigration work permit or temporary work permit.


It's of dubious legality to have that on their website because of the Civil RIghts Act. If you show up at their office they cannot legally ask you about your immigrant status.

However, even though it says this most US companies don't realize how simple TN-1 is to do, because all it requires is a carefully worded job offer letter, in some cases a regular job offer letter might be enough.

Actuary analyst is not on the NAFTA job list, that's the problem.

This is incorrect. An actuary (even at an analyst level) is considered as a mathematician under NAFTA. I got TN sponsorship back in 2005 as a mathematician, where my TN application clearly stated the job was as an actuary analyst. The TN status was renewed numerous times before I switched to an H1-B visa.
