TN1 Status -Lawyer looking for extra work

Post Wed Apr 13, 2011 3:20 pm

Hi! I'm in the US under a TN1 Status working as a lawyer. I've been looking into getting into some temporary contract work in addition to my regular employment. I was wondering if anyone has been able to figure out how to reconcile getting paid through the firm they are DHS authorized to work for, with temporary contract work with another firm. Since I can only be paid by my employer; is there a way to get around this limitation and do contract work for another firm? My employer has agreed to act as a middleman if this is necessary/possible. Anyone have any experience in this or any ideas?

Any help would be much appreciated! Thanks!

Why bother with this shell game? You are allowed to have multiple TNs, and can be a contractor, paid by 1099, as long as you get a new TN for each employer/client. This in not considered self-sponsorship.

That makes sense, but for contract work, I could potentially have a large number of temporary 'employers' and that wouldn't work. I can't go to a 'port of entry' every time a job is sent my way, that wold be ridiculous. Not to mention that a TN has certain requirements that must be met before it is issued and a temporary outsourced task performed remotely would not meet these requirements.

Anyone else have any experience here?

Well, you came here thinking that you could only be paid by your employer, and now you now that you can be paid by a client, so that should open up some more avenues for you -- you're a lawyer after all -- to persue.

Your current employer could act as your 'agent'. This may only require a second TN, from the same sponsor, which would be worded in such a way to allow "temporary outsourced task performed remotely" (which is quite acceptable for a TN point of view, btw).
