TN1 Visa letter - wording help!

Hi all!

I'm going to be moving to Chicago to start a new job mid next month. I've been reading forums and online info regarding the whole TN1 visa process and think i've got the majority of my documents together.

My only question is - in my letter from the company, their lawyer wrote that my employment was for an "undetermined amount of time, but minimum 6 months".

I know wording is a very sensitive issue on these letters, should it be changed to specify some kind of an end date?

End date is really important, should say something to the effect it is a temporary job that will not last more than three years. You can have another temporary job that lasts another three years directly afterward of course, but the letter needs to say that.

My lawyer did this for me of how to make a letter but of course, I need some comment from the expert in this forum to respond.

She will be paid a salary of $25.00 per hour. The employment will be full-time consisting of approximately 40 hours a week.

I'd put "temporarily" after "facility" I think. And lose the rest of the sentence after "three year period". There is no "TN visa" per se and it's obvious you're entering the US. Might want to put the end date in after "three year period" e.g. "for a three year period ending on x date".

These are the regs fwiw:

(ii) Documentation demonstrating engagement in business activities at a professional level and demonstrating professional qualifications. The applicant must present documentation sufficient to satisfy the consular officer (in the case of a Mexican citizen) or the Department officer (in the case of a Canadian citizen) that the applicant is seeking entry to the United States to engage in business activities for a United States employer(s) or entity(ies) at a professional level, and that the applicant meets the criteria to perform at such a professional level. This documentation may be in the form of a letter from the prospective employer(s) in the United States or from the foreign employer, and must be supported by diplomas, degrees or membership in a professional organization. Degrees received by the applicant from an educational institution not located within Canada, Mexico, or the United States must be accompanied by an evaluation by a reliable credentials evaluation service which specializes in evaluating foreign educational credentials. The documentation shall fully affirm:

(A) The Appendix 1603.D.1 profession of the applicant;

(B) A description of the professional activities, including a brief summary of daily job duties, if appropriate, in which the applicant will engage in for the United States employer/entity;

(C) The anticipated length of stay;

(D) The educational qualifications or appropriate credentials which demonstrate that the Canadian or Mexican citizen has professional level status; and

(E) The arrangements for remuneration for services to be rendered.

What do you mean by this? Do you mean that my letter was inadequate. I have other sample attached, let me know if this done well too..


This is to verify that W....B..... , a duly Registered Nurse in the state of California is employed by

Travel Company X
address ......

Ms B...... will reside in the state of California where she will be assigned to work in the CVICU, Cardio Vascular Intensive Care Unit, at Mama Mia Medical Center, Yaba Daba California, effective September 6, 2002. It is our intention to retain Ms B.....'s services for a minimum of six months to one year from date of hire. Her assignment at Mama Mia is for a minimum of 4 weeks, with an option to extend. If she opts not to extend she will be assigned to work one of several hospitals That Travel Company A staffs throughout the country. Ms B..... specialty provides critical care that consists of performing patient care duties and taking care of acutely ill patients. She is guaranteed a work week of minimum of 48 hours per week at a rate of $35 per hour. She will per provided housing and medical benefits while on assignment with us.

Travel Company X conducts thorough reference checks, background checks and random drug screening on all employees. Ms B...... meets or exceeds all of our standards and qualifications. There is no such thing as a "TN visa", you enter in the TN-1 category if you are approved, and the approval is based on the letter, that example said if you entered on a visa - well you're applying for approval, not entry after approval. There is no visa involved.

That other sample you've got there is way too vague, needs a specific end date, e.g. "this job is a temporary full-time position and will end on x date" and that date must not be further than three years in the future. Your TN-1 expiry date will be based on that date.
