Travel to Canada while PERM pending

Hi,

I am a Canadian citizen.

My company has filed PERM for me. (However It's currently under audit)

I need to drive to Canada for a visit.

Is there a rule that stipulates that I should not be leaving USA while PERM is pending?

No. You may leave and, more importantly, come back without any issue.

There is never any rule that you cannot leave US while any immigration-type process is under way.

Some processes however are considered abandonned when you leave (like I-539, or I-485 without an AP, L, or H). PERM is not one of them.

Also, the undertaking of some processes make future entry on non-immigrant status difficult or impossible. PERM is not one of them and even if it were, your H1 would override such concernes.
