Trying to figure out the best way to do this

Post Thu Nov 20, 2008 2:27 am

Hello everyone,

I am trying to figure out the best way to orchestrate my newest business deal. I am in the middle of negotiating a major deal with a large US based company. Part of my negotiation is for them to hire me as an executive to oversee the development of this new product.

The question is, what is the best way to be legally able to work in the US?

I don't have a degree that can be used and my current position is as a supervisor for a major hotel chain in the corporate customer service department.

Any help would be greatly appreciated.

If you haven't got a degree and it doesn't require one, it will be difficult. If it does require a degree and you have equivalent experience, you might be able to get Hotel Manager on TN-1, but it still requires some sort of diploma. Have a look at the TN-1 NAFTA categories list.

Failing that the only thing I can think of is that you go in as a treaty investor under E-2 and work as an independent contractor for them, however I'm not sure it sounds viable in this situation: http://toronto.usconsulate.gov/content/ ... ment=evisa

There has to be some substance to the business, an investment of some size that has some bearing on it, etc.

Generally speaking unless you're familiar with preparing financial statements and business plans, you should find an immigration consultant who is experienced with E visa applications to help you, as they are complex.
Steve.
