Turned Back At Pearson. What Now?

I'm going to point form my situation so it's easier to go through.
-Went through boarder at Pearson under Economist
-Was turned back as do not have 21 units in econ. I hold a bachelor in commerce. The courses in accounting, finance, and mangement are inline with what the job entails.
-My firm's lawyer had me go in under this with supoorting documentation stating that commerce is comparable to econ.
-When rejected I stayed calm and asked what I could do. Guard said maybe I could apply under something else.
-I notice that the Accounting category is closer to the actual job descriptions but the lawyer says you need an undergrad in Accounting not Commerce
-I was able to with draw my application for a TN at the boarder.
-The lawyer says he's looking into things but I've heard that my firm is thinking of cutting me off as this is becoming too much work.
-Does anyone have any advice?

Was your bachelor degree from US or Canada? The reason why i am asking is because of lot of the degree's from India and China are considered as 3 year degrees.

Not having a degree related to your job duties is obvioulsly problematic. Your lawyer is clearly realizing this.

Merely having many courses in a particular suject is not usually sufficient, as in this case.

Thanks, I have a Canadian degree. It's strange. I have talked with other who have the same degree that I have and have gotten through. I can't even find the 21 unit course rule on the Internet. Does anyone know of someone who got through under the Accountant title with a B.Comm but no CA or CMA?

AC2, I know at least 2 people from my undergrad who are accountants (staff accountants) in the US and are on a TN with a Commerce degree from a Canadian Business school BUT their major was specifically accounting.

I've also read on boards (but not personally known) about people who went as accountants with a Commerce degree and a major in finance. I did a quick search for you on the internet for jobs as accountants to verify the latter information, and yes, it does seem that several job postings for accountants in the US ask that you hold either an accounting degree or finance degree.

I was reading Garsmick letter and one of his letter said that US border Patrol is cracking down on TN Visa CAT Economist, it said that everyone is trying to enter the US under Economist so they are trying to trim it down a little bit.

I'll check again and see if i can post what i read in the letter

Thanks. I'm being advised to try again as an Economist with a different letter. I'm not sure if this is a good move. I was able to to withdraw the application at the border but they still know that I got turned back correct?

Perhaps it would be worth it to drive down to a POE that has a CBPO that's a NAFTA specialist? I'm not sure which one it is but there's is one in the Toronto area (by that, I mean, 2-3 hours away), lawsrlaws mentioned it before. Just do a search for it.

Once you have your TN, then you can drive back to YYZ and fly out. I know some will say that is not supposed to happen (getting your TN and driving right back into Canada) but I did it. I told the CBP officer right away that I was driving right back into Canada and why I had to, and he said, not a problem. He even showed me how to drive back into Canada.

Apparently, the experience of getting a TN is VERY subjective on which POE you go to and which CBPO you deal with. But I suppose thats just how everything is in life, in general lol

You didn't mention you were issued an I-275, which is a formal withdrawal request, which may carry a slightly more serious undertone than just a verbal denial. Consequently, trying at any port might become a serious matter depending and perhaps you may want to consider personal legal representation at the port of entry.

The laws and regulations pertaining to NAFTA adjudications are always subject to interpretation and even though you are slightly lacking in major credits, you possibly could be viewed as eligible depending on the Free Trade Officer.

You should not reapply for TN Status again without legal consultation if you were issued an I-275.
