U.S. Citizen marrying a Canadian

Post Mon Mar 02, 2009 9:41 pm

I looked for a situation close to mine on here and could not find, so hopefully someone will help me out. I am an American citizen looking to get married to a Canadian, she is currently in the U.S. teaching, and has a S.S. #. I have no clue where to start with paperwork or how long it will take, the wedding would take place in Canada, and we would return to live in the U.S. what is the proper procedure? What needs to be filed before the wedding and what needs to be filed afterwards? Is there a way to talk to a consulate and discuss this or does someone here have all the advice i need? Thanks!

What sort of status does she currently have? TN? H1B? When does it expire?

Your problem may lie with getting married in Canada. If she leaves the US, then gets married to you, then tries to re-enter the US the could deny her entry and then bar her from coming back until she gets a spouse visa (which currenlty take about a year to process).

I'd reconsider the wedding in Canada until *after* the process is complete. For now just have a civil service at the courthouse or something.

For marriage based immigration to the US info go to http://www.visajourney.com ALL the info you need is there, we're primarily a traveller's forum here, not immigration.

Yeah, get married to her in the US, then file I-485, I-864, G-325A, I-765 etc. and once it's approved and she has her PR card, do the ceremony in Canada (or get advance parole if you really can't wait).

Not very romantic I realize but bureaucracy never is.

My friend got married in her living room and the ceremony was months later,
