UK/Canadian Marriage

Post Wed Dec 10, 2008 12:31 pm

Hi Guys,

Am new so any information or advice would be appreciated!

I am a British Citizen and have been in Canada on a visitor Visa for the last 18 months. My husband (canadian passport holder) and I recently got married (Dec 6).

My extension was refused, so I have to go back to the UK. I leave Canada on Dec 16.

He wants to join me in UK for a year or 2 so that we can travel and work, then we plan on settling in canada around 2010 (and he will sponsor me for PR). What is the best visa to apply for before he leaves for the UK? He works for a US company in Canada (works from home) and is planning to keep the same job whilst we are in UK. Would he need a work permit for this?

Thanks so much!

Natalie

yes he will need a visa to be allowed to live in the UK. He should apply for a spouse visa before moving to the UK.

Joanne but he does not need a visa to visit. Canadians do not need a visa to come to the EU. I am in the same kind of situation as Natalie.

My fiancee is Canadian and has visited before. She is coming for Christmas too but in the summer, we plan to get married and she will move here. I fail to understand why all this visa stuff is necessary if you are married to the citizen of a country.

Greenman,

You are correct to say that if her husband wanted to visit the UK (up to 6 months) he will not need a visa. However, she wants her husband to live and work in the UK so he needs a visa before moving to the UK. The same will apply to your fiancee once she decide to move to the UK (to live and work).

Visas are necessary to keep control of immigrants, it doesn't matter that the person is married to the citizen of a country (but it is easier to get a visa). They have to see who are coming into the country, their background and financial situation. If not, criminals could just get married to someone in the UK and move here ! Visas are the norm for any country.

Hope this helps

Joanne
