UK passport, ancestry visa or tier 2 intra-company visa?

Post Tue Jan 04, 2011 8:22 pm

Hello everyone!

I will be moving to Scotland with my wife as part of an intra-company transfer from the Canadian office to the UK office and I am not sure which paperwork I should fill out for my wife and I.
- Should I get a UK passport, ancestry visa or tier 2 intra-company visa?
- What would my wife need?
- We are both Canadians born after 1/1/1983 and over 21

Since my father and grandparents were born in the UK as far as I can tell I can get a UK passport or an ancestry visa.
- It seems like a lot of people on this site get ancestry visas but in most cases would you not also qualify for a UK passport?
- Why would I get one over the other?
- In the long run the UK passport seems like the best option

Since my company is requesting the transfer I can get a Tier 2 intra-company Visa but I'm worried about the upcoming restrictions in April affecting the process.
- Is this a better option over the UK passport or ancestry visa?

Regarding my wife
- Which visa or passport option I use would be the best option for my wife to fall under?
- What visa form would my wife fill out?
- They have stopped accepting Tier 1 visas so if she has to fill out a Tier 1 visa would they allow her because of my status?
- FYI she plans on working in Glasgow and we have been married less than a year

Thank you for any help as this process is very confusing!

I had the same choice and here is my thought process (I chose passport).
Pros of citizenship: quicker process. allows you to live and work anywhere in Europe. Don't have to move to UK (i wasn't planning to ever move there).
Cons of citizenship (dy descent): don't automatically pass UK citizenship to children (they need to be born in UK). Process has gotten more complicated in last couple of years. You have some time, so that shoudl not be an issue.

Pros of ancestry visa: if you have another reason to move to UK and you are moving, you put yourself inline for "better" UK citizenship down the road, by naturalization, which would give your future children UK citizenship even if not born in UK.
Cons of ancestry: It is only a temporary visa (you have seen how fragile the visa situation is). It allows you only to work and live in UK. You are still subject to immigration restrictions. You have to be moving to UK to get it. you will eventually want to naturalise.

I don't think your assumption that most people who claim ancestry could were also qualified for citizenship. There are many more second-gentation Cdns with UK ancestry than there are first-generation, for example. Second-generation Cdn are only entitled to Ancestry visa.

I believe it would be much easier for your spouse to move live and work in UK with you being a full-fledged citizen than either other scenario, but that would be for others to determine.

I'm so glad this forum exists because I cannot find anyone to formally ask from the Gov't or affiliates.

Does anyone know if I need to have confirmed residence in the UK before my wife can apply for a spousal visa if I have my UK passport?

Hi,
I am Canadian and my grandfather was born in England. I want to apply for Right of Abode or a UK Ancestry Visa. Not exactly sure which one applies to me yet. I've read some of the forums on the subject but cannot locate a website that has all the information and forms I need to apply. Can anyone help me out?
Thanks

You are not eligible for Right of Abode (this is only for children of some UK-born mothers, or some spouses of men with right of abode, who don't otherwise qualify for true UK citizenship), so UK ancestry visa is your only option.

The additional pages are informative (and will come up from the page I posted), but be assured that you are not eligible for Right of abode.

Focus on Ancestry.
