Do you mean Form *I-130*? I think I-129 is actually the petition for a nonimmigrant worker.

In any event I hope someone else can explain what it means when the consulate holds your registration open for a year after a denial. I haven't encountered that before--presumably it just means you need to provide all evidence requested (I'd certainly hope the letter from the insurer would cover that base) and then will be good to go. But it is never wise to assume anything in immigration land and perhaps someone else can clarify that part of the bureaucracy a bit better.

Yes, for a relationship visa, you would have filed the I-130 first, and then if you were going the K3 visa route, would have filed the I-129F, BUT if you were goin ghrt Cr-1 (or ir-1--depending how long u were married for) you would have just sent in the I-130, plus other docs such as the G-325A.

Which consulate did you goto for Your Interview? Its too easy emailing them for clarification. ALWAYS incluse ur case # in the subject line.

The consulate that I had to interview is in MONTREAL, QUEBEC

They do not have an email, or contact number just an mailing address.

I can ensure you they have an email addy, as I went to Montreal for my CR-1 interview in 2004 and they answered my questions via email. Sometimes they were quick, other times not. haven't heard in a few days, email again

Montreal-IV-DV@state.gov and ENSURE you put ur case # in the subject line of the email

Sorry I know about this email and I think it is only available if you having an interview because I was able to contact them through this email prior to my interview. I have tried to contact them after the interview and they have not replied back, it has been many months. My husband also has tried and has been unsuccessful. But thank you for the input

I dont understand why I need Medical Insurance in the US prior to me entering in the US. As everyone who has posted has agreed on this matter it seems ridiculous. Right now we will work on getting a letter from my husband insurance about him covering me as a spouse once I am able to be in the US because right now his insurance can't cover me as a Canadian residence. sigh

I'll hazard a guess and say they are requiring proof of medical insurance because of your current health condition and the costs of health care in the US, and the fact that you have joint sponsors. I *have* seen it a few times over the years where someone was denied because the consulate felt that the USC spouse would not be able to bear the burden of health care costs, which are quite hefty to say the least, even with insurance!

If your husband makes enough to cover the affidavit of support requirements, why has he included his family as joint sponsors to begin with? Does he or you have children from previous partnerships? If its just the 2 of you, his anual income only needs to be $18,212. And if you're married already, you should have filed income tax together in the US, which means you would have had to apply for an ITIN, which an insurance company can use in lieu of a SSN. They may not be able to enroll you until you are officially moved to the US, but you should at least be able to get a letter from them to say "yes, we'll add her to her husband's policy as soon as she is resident in the US".

If you have not been able to work since 2006 why not apply for disability in Canada? That way you'll have your own income, even after you move to the US, which will contribute to the household income. That would be taken into consideration, as you should have no break in payments from Canada, you can even have cheques auto-deposited to a US account.

If your husband's income on his own is sufficient to cover the affidavit of support, and the consulate is still waiting on you to respond to updated income information, I suggest you do a completely new I-864 with his updated income information and a letter from his insurance company stating you will be added to the policy as soon as you are resident.
