US citizan WANT to be in canada for my kids

Post Thu Aug 06, 2009 6:29 am

I have two questions we just cant find help with.
First one.
If I'm still legally married in Canada (divorce is in progress- and I've heard it takes a year at least is this true?), I myself am still a U.S citizen have moved back to the U.S for my now significant other. Can I legally get married in the U.S?

question two.
I didn't get residency of any kind when i was in Canada (alberta) but my ex was sponsoring me until she wanted a divorce. She IS a citizen, and we have two kids. One that was born in the U.S and another born in Alberta. She wont allow me to even bring them for a visit. and I AM going to move to Canada. because it seems thats the only way I will get to be with my children.
IS there any processes in getting a Visa or applying for residency that will be quick since my children are in the country? I want to move to Alberta as soon as possible but I'll need work and need to be able to have a place to live.

You can't get remarried until you're divorced. Which country it happened in doesn't really matter.

A minor cannot sponsor you for family reunification and clearly your ex doesn't want to do it, so I think skilled worker is the only way.

Essentially you have to have at least 67 points, so if you have a BA and a reasonable amount of work experience you will qualify and if your new spouse has significant qualifications or experience that can help (may be better to make her the primary applicant if she is better qualified).

The snag is that if your occupation is not on the list of 38 priority occupations it takes 2 years+ to get an immigrant visa. Even if it is, takes a year or so.
