If you put a US address and phone number on your resume you are in effect misrepresenting yourself. If they decide to hire you based on the information given on your resume, and then you tell them "ok, now you have to sponsor me for TN" they'll likely move on to the next candidate.

You can put Timbuctoo on your resumé, they cannot discriminate against you on that basis. How it works is that they offer you the job, and if they cannot get you legal status, then they can withdraw the offer. But they cannot legally refuse to offer you a job because you're a foreigner, that's illegal, as explained at length at www.eeoc.gov

They're not supposed to discriminate, but they do! They just see foreign addresses and work experience and move on to the next application. Happens all the time.

Which is why you should report them. It's not that big of a deal and it will make them think twice in the future.

Can't report them if they never contact those applicants, because you don't know you're being discriminated against because of nationality or immigrant status. They just say the applicant is not what they're looking for, or not qualified. Its a tough thing to prove, unless they say it outright, which not many are stupid enough to do I should think.

If you clearly fall under TN-1 for example and all they've got to do is write a letter and they won't even interview you because of that, that is discrimination, no doubt about it.


I clearly do and have fallen under TN-1 for some time now, but that prejudice is there within some U.S. companies. What suprised me most with that one is the fact they retain legal counsel who would issue a decision on those grounds that overrides a local branch offer of employment. You would think they would have a far better understanding of EEOC rules than those at the local level.

I think the TN-1 thing is not simple prejudice, it's more ignorance as a lot of US companies don't understand how simple TN-1 is to get. They think they have to get lawyers and so on involved and really it's just a form letter they need to write. I suppose getting a lawyer to write it might be an idea but going by the various comments on here I'm getting the impression a lot of immigration lawyers know virtually nothing about TN-1.

As for what is known as "hidden" discriminatory practices, yes it can be hard to prove, but it also works both ways - if you get the brush-off for what appears to be no good reason, then you have nothing to lose by reporting them to the EEOC. After all, you can't lose your job, can you?

Eventually if enough complaints pile up, the EEOC will do something about it.

Well I'm not saying that TN-1 doesn't have downsides to it, because the biggest problem by far is maintaining "non-immigrant intent" which many TN-1 holders don't even seem to be aware of. If CBP conclude you're living permanently in the US they can refuse entry, and there have been various horror stories on here from people who've had TN-1 and got denied entry because their car had US plates or something like that.

However actually applying for TN-1 is pretty simple really at least by comparison to the other work categories.

Obviously if you get offered a job for a period of more than three years then it's not an option, but who does?
