US UI in TD status

I and my wife both are Canadian citizens living now in California. My wife has TN status, I was laid off being in H1B status and now am in TD status.

My application for UI was rejected by EDD with reference to California UI code section 1253A (= "A claim for benefits with respect to that week has been made in accordance with authorized regulations") because "you are not in a satisfactory immigration status" .

Does it make sense to appeal?

That is correct. You are not considered "immediately available for work" when you are in any non-immigrant status other than possessing a vaild EAD or a Green card.

You are entitled to claim UI from California only if you return to live in Canada.
