&#x3C;b&#x3E;TN-1 for Management Consultant with BA and MBA&#x3C;/b&#x3E;

Good day to all,

I have some general questions regarding TN1 for a Management Consultant.

We are looking to hire a person part-time to act as a marketing consultant.  They will be filling a temporary position for one year, advising our executives on how best to develop new customers, produce marketing material and help us reach international customers, specifically in French-speaking regions, including Canada.

She has a bachelor's degree in Political Science and an MBA with three years experience.  The TN1 management consultant requirements state a bachelor's degree, but it does not specify a field of study.  There is really no such thing as a bachelor's degree in &#x26;quot;Management Consulting&#x26;quot;.  The position is not permanent, not full-time and definitely not supervisory management.  She will work in an advisory role.

What are your thoughts?  I don't see why this would not work, but maybe you all have some different ideas.

I will be starting a new job on TN status at the beginning of January, and am thinking of going down to look for apartments the weekend of Dec 12.   A moving company just advised me to get my TN approved before I actually move, so that they can have proof of my status when they cross the border with my stuff.  

Would it be smart to ask for TN on Dec 11,  when I enter for the housing visit?  Or is this too early?  Would I risk being denied entry altogether, or is the worst case scenario that I have to enter as a visitor on Dec 11 and try again later for the TN?

Question: In the case a TN-1 petition goes to USCIS for premium processing ($320 + $1000) and is delayed by a request for further information and then never completed as the offer is withdrawn due to delay, where exactly do the fees go?  After so many days, USCIS states the premium fee is returned and processing continues, however, is that and the $320 returned?

I am resigning a month before my TN visa expires. Problem is, &#x3C;span style="text-decoration: underline"&#x3E;&#x3C;span style="font-weight: bold"&#x3E;I need to stay 6-7 more days to take an exam in another state.&#x3C;/span&#x3E;&#x3C;/span&#x3E; So am I allowed to do that? Changing my status to B2 will cost me $300 I cannot afford (I-539 filing fee), and I need to know if I absolutely need to do that for only 6 extra days... well?

Also, will I be facing any trouble flying to the other state for my exam 3 days after my resignation, with a TN visa which is no longer valid?

I am just curious how to go abouts getting a temporary work visa for the States. Obviously I know some of the answers, TN, H2B, H1B.. 

Quick Backstory:
Next spring (2010), I am hoping to audition for a role in a theatre/stage show. The only thing is, is that to have a chance to be hired (get the part) you have to be eligible to work in the US for them to consider you. At this moment I am not. I live in Canada and would be returning to Canada afterward, with no intention of staying (the show is 4 months long, including rehearsals).  As I am returning to school for the next 3 years. I am qualified to do it, but need the to be eligible to work in the states before I even consider auditioning. I will also try contacting the company, but I know other Canadians have auditioned previously without a visa (or eligibility to work in the states) and have not made it for those reasons. This show is a once in the lifetime experience (and one time experience), and I'm hoping that I'll be able to at least be considered.  

I have heard of travel working visas, but you need to be a student beforehand (I will be one afterward). As well, I have looked into temporary working visa's with no luck so far. Anyone have any idea where to start? What to apply for? If this is possible? Is there anyway to apply for a get a visa, prior to actually having a job?

Hi,

I'm a past snowboard champion from canada. I won many world major titles during the years 1999-2004. Then I worked with major snowboard movie in 2005. and then I did only 1 international competition a year, getting 8th place in 2006 and 12th in 2007..and 2nd in 2009.
I know now my competition level is not as impressive as it use to be. So I wonder how I could benefit the US in my field of excellence.
I still have opportunities to snowboard for US film productions and to get photos in us based magazines.
I do not have any employer and will not have one. I only use my skills on a snowboard.
I've seen about EB1 and P1 visas. I wonder which would fit my actual position best and if it is, at all, possible to have it this way???

I search the forums but couldn't find the answers I'm looking for.
I will be working from Canada for a USA company. The US company will be paying me in Cdn $. 
My questions are as follows:
1. Do I need to pay any income tax in USA? or file any form?
2. USA company will be paying me with my name. Is it possible to claim amounts like vehicle lease, mortgage (since I will be working from home), office furniture, etc? 
3. Can I setup a corporation and even though, employer will be paying me not in the name of corporation but can I somehow claim that money as corporation?

Please advice.

I have worked with many plants within a large Canadian owned company for over 20 years primarily in factory automation machine building, design concepting, applications engineering, and project management roles over the years. 
A sister plant in the states has recently offered me a temporary job (1-1.5 years estimated) based on my &#x26;quot;technical understanding of automation dynamics, their products/processes, and inherent efficiencies gained through risk mitigation resulting in time/cost savings&#x26;quot;..... as they put it.
I do not have a degree but am certified a certified Tool Maker and PMP with lots of product/process specific experience. After researching the TN visa criteria, would it be reasonable to suggest obtaining a TN under the Scientific Technician category?  
My role essentially is to &#x26;quot;assess risk/deficiencies and assist the engineering/maintenance department in ensuring pragmatic changes within production, quality, cost, and time constraints are acheived.&#x26;quot;

Everything I've read says that Canadians visiting can stay up to 6 months. But I was reading something about the Visa Waiver Program, which I entered on, and it says I can only stay 90 days.

&#x3C;b&#x3E;Green Card Processing&#x3C;/b&#x3E;

I have a question about the green card process. I am currently waiting to receive H1B status in the US, and my employer will start the green card rolling sometime next year as an EB2. I have been told informally that at some point during the application process, so long as I am adjusting status from within the US, I can also file for spousal work authorization (she and I are both Canadians). Is that true? And if it is, how does it work?

&#x3C;b&#x3E;K3 Query&#x3C;/b&#x3E;

Hello everyone,
I've spent the better part of the morning looking through the forums but can't find information that would help me in my situation. Hoping someone can steer me to the right place...
I'm Canadian and living in Vancouver, engaged to an American living in Birch Bay (we live less than an hour away from each other, on either side of the border). We've decided that I will be the one to move to the States and start a new life as my work is more flexible while he has a good job and a young child who lives with him part-time. Here's the issue: I have a 17 year old daughter turning 18 in two months and we've been told we should get married asap before she turns 18 so that it will be easier for her to stay in the states, go to college there, etc. A K1 visa would take too long so we're looking at the K3 route. Our intention is to get married as soon as possible in San Francisco (we're planning to elope as we have too many friends and family members and can not afford a large wedding), and then apply for a K3 visa. I would return to Vancouver to continue working until K3 visa is processed but would visit my new husband and stepchild on the weekends. Once the Visa is approved, I'd move myself and my daughter over, apply for adjustment of status, then continue working (I'm a freelance writer, editor and website designer). Here's the thing: according to some of what I've read on these forums, the K3 visa requires that we marry in Canada -- if I travel to the states with the intention of getting married this could hurt the visa process. Is this true? We really want to get married in San Fran but would settle for getting married in Vancouver if we had to. And also, am I allowed to travel back and forth across the border while on a K3 visa? If so, why are there news reports of married couples being stopped at the border when trying to visit their new spouses in the states?

I will be applying for an H1B very soon using premium processing. I want to travel to the US from Canada in 2 weeks to go look at houses to rent. Someone at the place I will be working says I cannot enter the US while my H1B is pending so I have two choices, come this weekend before they submit for the H1B or wait several weeks for everything to be submitted and come down right before I am to start work and find a place. Does anyone know if these options are true? I mean how am I supposed to do this? A lot of homes for rent have the owners still in them and they are offering it up for rent because they can't sell. I would need to give at least 30 days notice for them to move out of their house.

guys;
my contract with my company where i was working on a tn visa ended around 3 weeks ago. i have been on vacation for 3 weeks.

glad to say that i have found a new job its a company based out of Toronto but do some business in the US as well

i am going for a management consultant tn.
i will have the following items

bachelors degree in business admin
tn letter
resume

Should i take the letter from my previous employer or the degree should be enough. Did anything else changed in one year with regards to tn visa?
my current tn expires in 4 days
