Hello, 

I've spent several hours reading many very useful posts on this forum and I have learned a great deal. I have a question of my own, though, that I'd like some advice / opinions on from anyone who has had similar experience. 

I am in the process of applying for jobs right now in the US, as a computer systems analyst. I have a B.A. (4 year university degree) but my major was Philosophy (yes, I know, how stupid of me  &#x3C;img src="http://www.canuckabroad.com/forums/images/smilies/icon_redface.gif" alt=":oops:" title="Embarassed" /&#x3E; ) I did not take any courses in computer science while in university. 
Anyway, I was lucky enough to get a job shortly after graduating as an ERP Implementation Specialist (Business Analyst / Project Manager). I have 5 years of experience at this company. 

My question is:  How likely am I to get a TN-1 with 5 years experience and a B.A in an unrelated field?

Also, I noticed on another thread someone mentioned this: &#x26;quot;The hardest ones to get are Systems Analyst and Management Consultant because the manual has specific warnings about those two categories in it.&#x26;quot;  Does anyone know what are the specific warnings about Computer Systems Analyst in the manual?

&#x3C;b&#x3E;A question regarding a TN visa and video editing?&#x3C;/b&#x3E;

I am new to all this and I just found out about this TN visa and I am wondering if I qualify. I just got offer a job in the US as a video editor for a web based production company. I have a college diploma in Media Productions, which included video editing among other media related subjects. I also obtained certificates in both audio and video editing but not from a university or college. I do have experience including shooting/editing  a documentary, some music videos, a concert DVD, and a few weddings.

I was looking at a list of occupations that qualify under TN status and I didn't see video editor but I was wondering if I would be accepted under it. If not does anybody know what work visa I would have to apply for?

I have been offered a great nursing position with the state of NY. I have my NY nursing license, Visascreen, diplomas and will be speaking with an immigration lawyer for advice on the letter of employment. I plan to leave Vancouver on April 11 with a start date of April 15th. I've had some less than pleasant experiences with land crossings (never denied entry) so thought I would go through YVR. I've been dating a US citizen for the past 4 years and am always honest about it at the border. We don't have plans to marry as that would complicate everything but we will be living together. I have a home in BC that I will rent out so I'll bring evidence of that. Any other advice? To be honest, I get sick just thinking about requesting the TN.  Thanks !!

Hello,

I'm getting an H1B (and my wife an H4) for employment starting in August. I want to obtain an SSN as quickly as legally possible since it's tied to so many things.

I understand that USCIS takes a few (10?) days to put you in the system once your I-94 is registered at the border.

I also understand that I can only enter the US about 10 days prior to the listed employment start date.

1) Could I just drive to the border on a shopping expedition, handle the I-94 paperwork and get it attached to my passport (giving our intended US residence), and then turn around and re-enter Canada for a &#x26;quot;visit&#x26;quot; (under 30 days) to get the process going? 

2) Could I instead visit a consulate and achieve the same result (officially recording my &#x26;quot;arrival&#x26;quot;) without the trip?

I was charged with assault (fight) in 1999 but not convicted of anything, community service only, no records. I got a pardon in 2005. I think since then I've had one speeding ticket, and even it got thrown out.

Unfortunately since I crossed into US between those times that arrest is in the INS database and sometimes I get hassled and it is embarassing when I have family in the car.

Is there any way to contact the INS and tell them about the pardon. This is a problem. I'm not going to get involved in anything criminal.

Hi there,

Big problem. Fell in love with a woman who lives an hour away from me across the boarder in Washington state. I live in British Columbia. I would like to see what it would be like to live close to her and have a bit of a more normal relationship. We've been together for 4 years. I have a good job in Canada and would like to try to live in the US and then commute to Canada 4 out of every 9 days for work. Is this possible? Do i need to get a visa? I am a Canadian citizen who moved to the US on a TD visa in September. I found a job and was granted an H1B visa in January 2010. Because I applied for a change of status, all my documents were mailed to me (I didn't get a stamp in my passport or go to a consulate).

I am planning my first trip back to Toronto next month and have heard that I can't get back into the US without an stamp in my passport (the I-94 card apparently doesn't mean anything). 

Do I need to make an appointment at the US Embassy in Toronto? Or can I get the stamp at the border (airport) when I'm coming home?

I appreciate any advice that anyone has! (my lawyer is not responding to my emails)

Hi,

I am looking for advice on taxes. Here is my situation:

I will be working in California on a TN visa. My wife will be coming on a TD visa.

My questions are as follows:

1) Can I remain a resident of Canada by keeping investment or bank accounts, belonging to organizations etc? None of my dependents or myself will live in Canada for 6 months of the year. The reason I ask is the TFSA contributions grow only if you are a Canadian resident, and I would like to take advantage of TFSAs if I can.

2) What are the major differences between being a Canadian resident vs non-resident? I assume I would not have to pay more tax than the greater of the two tax rates in any case. Are there any other considerations to take into account?

3) Is it true that I can not claim any deductions for my spouse while she is on a TD visa?

Thanks a lot. If you have any other general advice on things to consider before our move I would appreciate it. I will be getting a tax accountant for my first year of taxes in the US but I would like to ensure I do everything right before leaving as well.

I've been given an offer of admission to law school in America, and I understand that all I need at the port of entry is my I-20 certificate, proof of citizenship including my Canada passport, financial statement of support, and proof of ties to Canada.

At the American port of entry, I present all of those to the Officer, and he or she would require that I should write an I-94 card at the expense of 6 U.S. dollars. That would be equivalent to an F-1 status in the country.

I am not entering America from Canada though since I will fly from Korea and land at LA, and does the exemption of F-1 consular process still apply even when I do not enter the country from Canadian soil?

I'm sure my question must have been addressed in other ways but I would appreciate it if those who have gone through the process could shed some light.

My job descriptions are closer to Computer Systems Analyst as per the NAFTA job list. My employer is a big forture 100 company and will not change the job title. Do you think it will be an issue at the border to secure a TN visa? Obviously, they can say job title is not exactly as &#x26;quot;Computer Systems Analyst&#x26;quot;.

Also, if one gets denied a TN visa, will there be any adverse consequences for any future US travel as I travel South of the border for business and pleasure all the time.  I don't think it should be an issue but wanted to find out the experiences of TN rejecters.

&#x3C;b&#x3E;Help with H1B/SSN timing for a homebuyer&#x3C;/b&#x3E;

Hello knowledgeable forum people! I've looked in other threads but haven't quite got my answers.

My wife and I are in Montreal, and we're moving to Texas for my job.
My employer is getting me an H1B with premium processing (I can expect it to take 1-1.5 months, they say).

We want to buy a house (we're hunting in April) and close it before July 1 to qualify for the First Time Homebuyers Tax Credit.

To close on the home, we need a mortgage loan secured, which we can do with Wells Fargo (thankfully they have offered to use our Canadian credit history), however I will still need an SSN at that time to make them happy.

Assuming I get my visa approval by May 1 (approx), is this the right sequence of events:

1)Obtain an I-797 in the mail (approval for visa)

2)Get my H1B visa stamped by a visit to a local consulate for an interview with my I-797.

3)Drive to the border, get an I-94. I must present a stamped H1B visa at the border and give an address of residence (presumably the home we've chosen in April).

4)That same day, drive to an SSA and apply for an SSN in person and present an I-94. Then return to Canada to wait a month for SSN to arrive (surrender I-94 or no?).

5)SSN in hand, get back to Wells Fargo regarding mortgage?

Does anybody see a potential problem with me getting an I-94 at the border, finding the nearest SSA, then turning right around and going back to Canada to wait for the SSN? Does the I-94 assume I'm going to begin work immediately, or is there some kind of grace period?

My TN Visa was issued for 3 year duration and was due to expire in 2012. My passport, however was due to expire in May 2010. When I left Canada last time US Customs wrote on my TN Visa in my passport that it expires on the same date as my passport. I have since renewed my Canadian passport.

My questions are - 
1. Do I have to take a trip to Canada and when I return to the US get an extension on the visa?

2. Will US Customs at the Canada/US border give me the remaining time back by issuing a new TN Visa (white card)

2. Do I have to take this trip before May 2010, or will the remaining time to 2012 be given back to me automatically?

3. Last, can I not get this extension simply by going to the Miami airport without leaving the US?

Greetings fellow Members,

I was hoping that some of our resident tax Gurus could answer the following questions.

I'm presently working in the US (PA) on a TN visa.  I arrived on March 2009 and began work there immediately.  Before that, I was working for a Canadina company for the first 80 or so days of 2009.

In beginning my tax return, I spoke to the IRS at their general phone no. and, while they were generally clueless they did manage to inform me to file a dual-status tax return for 2009.  After reading numerous posts on this site among others, I seem to understand how to file 2/3 of the returns(the 1040 and the pro-rated T1 for my time spent in Canada).  However, I'm still confused about how to file the 1040NR based on the first portion of 2009 (the time spent in Canada).

From what I've read, I don't need to declare my world (ie Canadian)income on the 1040NR.  So based on this info, can someone explain:

1. what should I declare on the 1040NR ,or is it basically a series of 0's?
2. where, if anywhere should I claim foreign tax deductions for taxes paid in Canada?
3.Do I need to file the dreaded form 8833? (my gross income was &#x26;lt;100K if that helps any)
4. Where does the tax equalization treaty between Can and US come into play between these 3 returns?
5. Another option suggested on this forum is to file a 1040 for the entire year and claim tax credits for those taxes paid in Canada.  If I only stay in the US for 1 year, can I still use this approach?
