Vehicles and crossing with alien card

Post Wed Jan 13, 2010 10:02 am

Hi All

In bad need of help. I am a Canadian Citizen and I have been dating a US citizen for the past 2 years. This past Christmas we got married in the US here. I have hired an immigration law firm to thelp with the filing requirements. Soooo I am in that process as we speak. I am advised that I cannot leave the US until my paperwork is approved which is fine. I have a business in Canada that I need to be at from June to Oct every year and meet the US resident requirement. (ie here for 181 days) My problem is I have my truck is down here with me. What happens when I cross back into Canada this spring with a resdient alien card and my truck and drivers license are Canadian. I really want to keep my drivers license and plates in Canadian.

Secondly.....do I have a window of time to move some belongings from Canada to my US residense without paying duty and all the other non sense I may run into that i am unaware of.

Lets start here. I do have other questions. My immigration lawyer cant seem to answer these.????

With a green card (once you have it) and Canadian citizenship I'm guessing you won't have any problems actually crossing the border in either direction regardless of what tags are on the vehicle you cross with.

However, I highly doubt that your Canadian auto insurance company, your former Canadian province, or your new US state are going to be okay with you maintaining Canadian registration / insurance on a vehicle that is here in the USA, and belongs to a GC holder, more than half the year.

As a GC holder, the USA is your residence. Your vehicle should be registered here if you are making only seasonal trips to Canada.

Once you have your paperwork completed and have your GC, you can go and get your personal belongings and there is no duty to be paid. Just make sure you have everything in order.
My husband went and got all of my belongings because I had applied for a temporary travel document that was approved but had my husband's birthdate on it. I was informed by our lawyer that it would be up to the border guard whether I would be allowed back into the US if I went to get my things with him. Anyway, he went alone and just needed to show our paperwork and they inspected the contents of the truck at the border and that was that. No problem.
