Very simple question on working in the US

Post Wed Dec 03, 2008 10:49 pm

Hi, I am a Canadian citizen and my ex-employer sent me to a US client every week on TN visa. I like the weather very much and plan to find work in the US on a contract basis next year. I have a technical degree and had no trouble getting a TN in the past. As a contractor, should I apply for a TN visa like I did before? Or is there a better way? Also am I allowed to buy a property in the US?

Well first you have to find an employer to sponsor the TN.

This thread covers the property situation: http://www.canuckabroad.com/forums/cana ... t2836.html

But short answer yes, anyone can buy property in the US, but getting a mortgage from a US bank will prove difficult at the moment.

Thanks for the replies. Assuming I found a company (corporation) willing to hire me as a contractor. I will essentially be self-employed. But based on the information below, self-employment is not allowed in the US. So I am a little confused as to if I am be eligible to work on a TN.

"The applicant must present evidence of professional employment to satisfy the Consular Officer of your plans to be employed in prearranged business activities for a U.S. employer(s) or entity(ies) at a professional level. Part-time employment is permitted. Self-employment is not permitted. An employment letter or contract providing a detailed description of the business activities may be provided from the U.S. or foreign employer, and should state the following:"

You can't be self-employed on TN-1. Or not in a way that you appear to be self-employed to USCIS at least. I suppose in reality you could be subcontracted but legally you would be directly employed by them.

The only way I'm aware of to enter the US and be self-employed is using an E visa, or EB-5, immigrant investor.
