visa choices for Canadians

Post Fri Jun 22, 2007 8:43 pm

My mom has a E-2 business visa in the USA. I was a dependent under her E-2 until I was 21. I continued to stay another 1.5 yrs. After being in Canada six months I want to go back to be close to family.

Can someone offer some hints on how and which status to apply for with my previous status in the US? Is my previous status relevant to applying independently and from outside the US? Any help would be appreciated. Getting settled in Canada has been tough and I can't afford an attorney. I am researching plenty, but if you can offer anything, I would greatly appreciate it. Thanks for your time.

Cache 22. If my education comes up and is scrutinized, they will see I overstayed my E-2 status by 4 months. I turned 21 4 months before I graduated from university. Hmmmm. Anyone got input?

Did you get a degree at university? Anything that would qualify you for a TN visa?

The overstay may (likely) or may not hinder any future visa applications, but having had status under a parent's E2 previously will not necessarily qualify you for anything now that you're on your own.

If you're eligible for a TN visa, and you find a job with a company in the US willing to sponsor you, they may well have a lawyer on staff or on retainer who can assist with the overstay. This may be your only option.
