Visiting the States for love

Post Wed Apr 13, 2011 7:50 pm

So I fall into the category of "fell in love". My story is slightly different. He is a Canadian and we grew up most of our lives living a block away from each other and going to all the same schools. We have know each other since we were 5. However when he was 15 his mom married an American and they moved to Ohio. We eventually decided that no matter how far away we are, it wouldn't change are feelings. We have been flying back and forth to see each other ever since. He does have his green card and a permanent residence card. And is planning on getting his U.S. citizenship soon. Now I want to go down there for longer then a week. I know I can stay up to 6 months and then I must return to Canada. How long do I have to wait until I can return again? And could I stay for another 6 months when I did go back.
We do plan to get married, but not yet. Do I have to be in the States or Canada when we apply for a fiancé visa? I do realize that once I apply for the visa I have to go back to Canada and can't come back until 90 days before the wedding.
Can anyone help shed some light on any of this? It seems all so confusing and difficult. All I want is to be with the man I love and won't stop till we are together (in the same country) hahaha
Thanks!

Visajourney.com has all the info you need.

Rememebr that, at the very minimum, for theentire time you VISIT US, you must maintain a full-fledged home in canada, and sufficient ties there to assure the admnitting officer that you will return to canada within the agreed upon time limit.

You can enter for six months at a time (if the officer allows) as many times as you wish, there is no limit on the number of days per year (caledar or otherwise). There is only a per visit limit of six months. However the more you stay in US, the less credible you will be when requesting entry as a visitor.

Weird--I jotted down a huge reply!! So I shall put down a shortened version: Some VJ sites to look at:

k1: fiance visa
CR-1: Married for less then 2 yrs (((IR-1 is married for 2 yrs or more))
K3 is pretty much gone the way of the dodo bird!!

Compare K1 and CR-1:http://www.visajourney.com/content/compare

K1 guide: http://www.visajourney.com/content/k1guide

K1 forum: http://www.visajourney.com/forums/forum ... rocedures/

CR-1 Guide: http://www.visajourney.com/content/i130guide1

CR-1 Forum: http://www.visajourney.com/forums/forum ... rocedures/

OVERVIEW http://www.visajourney.com/content/fami ... n-overview

The best thing he can do is get his USA citizenship FIRST!!!!!! He can't file the k1. Sure he can file for the CR-1, BUT the wait is a LOT longer as only a permanent resident!

Read VJ. The paperwork process is not that hard--it is the waiting that bothers most!

1 can visit while the process is ongoing, BUT it is up to the port of entry(POE) officer!! SO have ties to CANADA! Such as return airfare, utility bills, apartment lease, letter from employer.

Canadians DO NOT have a right to enter the USA--Simple as that, so have those proof of ties to Canada. My advice when visiting:

Canadians Visiting the USA while undergoing the visa process, my free advice:
1) Always tell the TRUTH. never lie to the POE officer
2) Be confident in ur replies
3) keep ur response short and to the point, don't tell ur life story!!
4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!
5) Pack light! No job resumes with you
6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)
7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!
8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied, that is if ur polite and didn't lie! Refer to #1

I went thru the CR-1 process back in 2004 and it has changed a bit now!

Only place in Canada that does CR-1 interviews is MTL! For k1--Mtl and Vancouver do them--based on where u live in Canada!

Best of luck--READ THE GUIDES--no 1 cares more about the process than YOU!!!! Especially read the + and - of the k1 and CR-1 visas!!

Best of luck

The fact that the person does not have citizenship yet, in reality makes it easier for her to cross the border -- since he cannot sponsor her for immedaite GC.

However, the fact that he doesn'y have citizenship yet, also makes the process of getting her GC much longer -- since he cannot sponsor her for immediate GC.

LIke flames sez, he should get his citizenship pronto, or you will not be able to be in US for very long without troubles.
