Your forgiven, this is not really an immigration site.

For H1-B, The sponsor files a Labor Condition application (LCA), not labour certification (LC). All H1-B applicants do this; it is merely an description of job conditions. It is not a 'prove you are unique and indispensible' petition that would be needed for an I-140.

What the non-profit would be able to do is hire the worker regardless of the yearly quota. There are also some conditions that the employer may meet which would get some if not all of the H1 fees waived.

Oh OK! I confused the difference between the two labor forms. I'll let her know of both options but the employer needs her asap so she may be better off getting the TN then maybe switching to the H1B lateron if the employer wants to do it that way.
