Volunteering while waiting for I-765 approval

Post Wed Aug 03, 2011 1:24 pm

Hi,

I just arrived in the US on a K-1 and have married my husband, I'm looking for some specific guidelines about what kinds of volunteer work I can engage in while I wait for work approval. My husband works in non-profit and we have connections to a lot of great organizations that are volunteer-run. Here are my questions:

1. Are there any restrictions to the kinds of volunteer work I can do?
2. Do I need to obtain proof that the work I do would not otherwise have been done by a USC for money?
3. Do I need to fill out any additional forms to apply for permission to volunteer if I'm already here on the K-1 and have submitted my application for adjustment of status?
4. Are there any official places that NVC or USCIS have listed the regulations surrounding volunteering? If there are, I couldn't find them.

Thanks!

There are no forms as such. All you need to prove is that (a) you are working for a non-profit, and (b) they do not typically pay for that position.

The non-profit will know more about this. They typically have to keep an I-9 on file for their paid employees.

When you have your GC interview, it would look mighty suspicious if suddenly the firm you volunteered for started to pay you. Other than that
