Want to marry a US citizen and move

Ok, I was browsing the forums and found some very interesting topics and I was hoping for some help for my personal situation.
My boyfriend currently resides in California and is waiting on the finalization of his divorce. We are planning on getting married and I would be moving there from Canada.
We have been waiting quite some time and would like to move forward as soon as possible.
I have a few questions. When the divorce is final is it a good idea for me to visit him again and just marry while I am there?
If we take that route should we just file the spousal immigration process? And will I be able to stay there while the application is processed?
Another question I have is about working. I will obv need to seek employment and was wondering if we did it this was how long would I have to wait before I was able to apply for work.

I have read online about applying for a fiancee visa but as I said we have been waiting for quite some time and would like to get me down there as soon as possible.

Any help and insight would be much appreciated tyvm =)

I see this all the time.

Big hurry, been waiting a looong time, but didn't bother to file for a fiance visa. Just do what everyone else does and move and work illegally.

If you have been waiting so long, then you had time to do it the legal way. Applying for a visa. No offense, but people like you cause all the problems for people who do things the right way.

Visit www.uscis.gov and it has information there as well as the wait to process different visas. This question has been asked so much on the forums that if you did a quick search, you'd probably come up with many threads.

Your way to go is fiance or spousal visa. However if your intent was to marry a U.S. citizen and stay in the U.S. and you tell the border guards it's just a quick visit - you can be removed from the U.S. Your INTENT upon entering is important.

Just visit the www.uscis.gov or www.visajourney.com, which also gives great information! Good luck!

Gonna have to agree with laws on this one. If you've waited this long, you can wait a while longer to do it the legal and correct way.

Go to Visa Journey (linked above) ALL the information you need is there.

I agree with this post minus the sarcasm in the second post. :) However, truthfully speaking, it's always better to wait until your visa is approved before you fly down to the U.S. to meet your loved one only to mess things up for the both of you. You will find in the end once your paperwork is approved that is was worth the wait.

No, because you lied about your non-immigrant intent when you entered.

Bear in mind it's also actually cheaper for him to file an I-130 to sponsor you for a CR-1 visa compared to applying for AOS from B-2 and it's also relatively straightforward because you enter as an LPR so the paperwork is also easier.

Yes it does take some time to get an immigrant visa, but given the death of the economy, USCIS have less work to do lately so provided he fills the forms in correctly you should have your visa in seven months at most.

The usual thing that catches people out on this process is the requirement for copies of 1040 tax returns for the last three years, so he needs to be up-to-date with his taxes.
