Is it better to wed in CND or the US to do this?

Well, considering the spousal visa process is taking about a year these days, if you get married tomorrow and send in all the applications the day after, your timing will be about right.

You can get married in either country, doesn't really matter. If you decide to get married in the US, just make sure you have absolute proof of ties to Canada. Like rent or mortgage to pay on a home, full time job, utilities bills etc etc etc.

And yes, you should still be able to go back and forth for short visits in the interim. Just always be sure to have proof of ties to Canada. Its no guarantee of course, but its not against the law to visit. If you're ever denied entry to the US, your spouse can always visit you in Canada until your visa process is complete. A denial of entry will not negatively affect later visa applications.

Reba,

I understand Canadian spouse visiting US wife/ husband needs to show ties to Canada ,if he/she doesn't have a valid working visa H1 or marriage visa CR1 / K-.
How about vice versa? Wouldn't the US spouse need to show the same thing to the Canadian guards?

Doesn't really matter where you get married, just make sure your US spouse has evidence they live in Canada when crossing the border (driver's licence, healthcare card, etc.)

It will actually benefit you to stay in Canada for a year after getting married because of the time it takes to get the visa.

Yes, he would need to be a permanent resident of Canada so she would have to sponsor him for permanent residence in Canada.

If the US spouse is coming to visit Canada then yes, they would have to show the same ties to home country, but usually the Canadian side is not quite as difficult. If the US immigration paperwork has already been submitted when either one tries to visit the other, a photocopy of the receipt notice from USCIS usually will suffice to show officials that the US half has ties to the US, and that the Canadian intends to go thru the proper immigration process.
