Want to move with my boyfriend in USA

Hi I am Canadian and my boyfriend is American living Charlotte NC, I met him during a trip last January.
Our relationship became serious, we just spent a month together and decided that I move there in 2012 because he has a good job and he has to work another 5 years to get retirement.
What is the laws for moving to USA, what should I do?
Also, I have a 7 year old son and he will move with me and my boyfriend. I Do not Know What to do, can I moved all my furniture, plants ...... ?

Visajourney.com If your not married now, BUT plan to, then look at the k1 visa (fiance visa) but one does have to get married within 90 days of crossing the border with ur visa! Keep in mind, a k1 visa takes around 6-9 months to GET!!! paperwork to send in and an interview in either Montreal or Vancouver--based on where you reside in Canada

and yes some people goto the USA, get married and then start the CR-1 (already married) paperwork. Stay and visit in the USA, then head back to Canada!

And yes when you have the visa, you can load up ur car, ur uhaul, or have movers, move all ur stuff tothe USA. Can even take ur car, just one has to have a compliance letter from the manufacturer. And if u have a loan, some banks, want it paid off??

Visiting the USA while ur visa is in process?? Simple answer is YES, but it al depends on the port of entry (POE) officer!! Ensure you have proof of ties to canada, to show that you will be returning! Job letter, mortgage/lease info, utility bills, return ticket, etc! All boils down to the POE officer. U can have 100% concrete evidence, and he can still deny u

But the above is all moot if you don't plan to get married. But read over the guides on the k1/cr-1 forums! Everything u need is on VJ, step by step instructions, examples of filled out forms! The paperwork wont kill ya, its the waiting that can!!

I don't think we plan to get married, but who know lol. If we don't have choice I think it's a possibility to consider but I don't want to get married for enter to USA.
Can I move to states with all my furniture in july 2012 and then ask for a visa?
When you said * Stay and visit in the USA, then head back to Canada!* how many time I have to be in Canada to return live in USA.

Before asking a visa I have to talk with my ex and he has to sign paper to let my son enter and live in USA. And if he start to be bad, I have to go to the courtroom ask to the judge let us living in USA with my boyfriend.
Do I ask the visa even if the things are not complete with my ex for my son? I don't want to live in USA without him.

Why you said *depends on the port of entry (POE) officer!!* ? I have my passport and if I get my visa I don't see why he shouldn't let me enter in USA.

I have a lease here (end 2012 june 30) and I have to give my notice in february to move in july 2012 so, visa or not I will have to move my furnitures somewhere but I want it's in USA, is it possible? Is it a problem if I move my stuff before to get my visa? I don't see why your gouverment should refuse me in USA.
The customs can he forbid me entering the USA with my furniture if I do not have a visa? Even if I'm going to get it?
I'm a good worker, I plan to find a job when my son starts school (just time for me and my son to be good big change for us and language) is it a problem for my son to go to the school in USA? Do I have to do something before move there? To find a job do I need absolutely a green card or they give me one when I ask for a visa?

I'm sorry, I'm ignorant about it, I don't choose to love him it's happen like that, I would prefer to stay in Canada (even If I hate winter lol)for the *condition* (med care....) and my job, familly and friends, but he works in a University so I can't ask him to leave his job and come here and work for another 20 years...... when he can get his retirement in around 5 years.
It make me nervous, it's like I'm blind and I don't know where to go.

Your scenario simply will not work. To even live in US, you need a sponsor, which can only be a US family member, a spouse, or an employer.

Your son cannot go to school if you are only a tourist, and you cannot simply work unless you have a profession and a sponsor.

Ur options are a Relationship visa or a work visa. 1 has to realize that the USA is another country and their is certain way 1 has to legally gain access to it. Many Cdns take that for granted and they figure they can just pick up and move to it. Thats so not true!! If you don't belive us, load up ur car, goto the USA border and tell the POE officer ur intentions. You will soon be heading back to Canada,lol

Canadians don't apply for and get tourist visas like many other countries do. If ur going down to the USA to visit, the POE officer makes his decision right on the spot. A cdn can (with POE officer approval) stay up to 6 months, but he can say only 2 weeks, 2 months, 17 weeks, etc etc up to 6 months! NEVER lie to a POE officer. They catch you in a lie, the one could be in a world of trouble. They can deny you entry, which can be a pain, but not a huge deal. BUT if they BAN you then ur in a world of hurt,lol Even if u then decided to go the k1 route, that ban would require u to file for a waiver AFTER the interview! 6-9 months to get the k21 interview (for Montreal, Vancouver is abit faster) THEN u file the waiver which can take a long time. 1 person i recall after a year to get to the interview, took another 13 months for the waiver to be approved.

I only know the relationship visa stuff, and i'm no expert. But uf you have no intentions of getting married, then that leave u an employment based visa and one has to have specific skills to get one. Best of luck

well, so we don't have choice to be married if I want to live with him. That's horrible to get married just to go live with my boyfriend. I don't know what to do, I don't think he want marry someone after been divorced.

I just don't want to be married for that reason. If we do it it's because we want it not because we're forced to do to be happy together. And I can't imagine my life without him.

Ur options are work visa, relationship visa or go visit for up to 6 months, or make short trips! Long distance relationships suck! My wife did it for over 3 years before I moved to the USA. The airlines loved us,lol Sooner or later 1 has to make a decision, keep doing visits or 1 has to make the sacrifice and move somewhere. Never an easy decision. No 1 said love was easy, lol Best of luck

Hey i'm also wanting to live with my boyfriend and don't want to be rushed into marriage until we are both 100% sure. From my understanding Canadian citizens are allowed to visit the United States for up to 6 months a year. Why would i apply for a B-2 if this is the case? What happens if i go move down there for that 6 month period, then want the B-2 extension but never got the B-2 originally? What do i do then?
