Wanting to marry an American in FL

Post Tue Dec 09, 2008 6:11 am

I am Canadian and I want to marry an American in Florida. Do we get a marriage licence from the clerk just as an American would get if they were marrying another American or do we need something else?
After we are married I would return to Canada and apply for a visa to move there with him.

You can go to the Clerk's Office (link below for more info)

From a websearch in regards to Marriage in Florida;
All U.S. Citizens and Residents must provide their Social Security Number. Non- U.S. Residents may provide an Alien Registration Card, Driver License, Passport or any other legal form of identification if they do not have a Social Security Number issued to them. Requirements for getting married in Broward county include a second form of ID if a U.S. Social Security number has been issued. The following forms of proof are accepted: original Social Security card, US Military Card, original printed paycheck stub, W-2 form with applicant’s name and social security number, SSA Medicare card, Third Party Notice or Future Benefits Earning Statement from SSA with the complete social security number.

County Clerk Directory;
http://dlis.dos.state.fl.us/fgils/coclerks.html

A little trivia: Tennessee only recently begin allowing people to obtain a licence without a SSN. They had 'imposed' the rule presumably to track deadbeat parents, but it was seen as 'profiling' moreso geared to the Hispanic community. Interesting enough, it was a lawyer who applied (her Fiance had no SSN and was refused) for a marriage licence who really started the ball rolling to change the directive. Waiting periods, costs and such vary from state to state, but the information is readily available online.

Most counties will require that you sign an affidavit saying that you are not a US resident or citizen, and therefore do not have a Social Security Number. That's all I had to do in NC.

When my US bride and I decided to marry I was advised to apply for a K-1 visa. This allowed me to move to and remain in the US provided we marry within 90 days of my entry. This took aproximately 5 months from application to approval. I was told that this is a lot quicker than marrying then applying for entry.I applied for my SS as soon as I arrived in TX. I was able to get married while my application for a SS was pending.

I applied in early April of 2002 and received my K-1 in mid August of the same year. Delays were created by the switch of the INS to Homeland Security control post 9/11. The rules changed mid-stream causing some confusion (mostly on their end).The RCMP clearance also was a delaying factor, they did not move too quickly. I had no issues which would cause any concern for my approval.
We were advised to apply ourselves as working through a lawyer caused 3rd party delays. Once I moved to the U.S. it was 8 more months before I was able to work. This delay was caused mostly because of new rules being implemented with the change to Homeland Security and, as I was later informed, internal management problems within the Dallas INS office. Don’t be afraid to petition your local congressman for help if delays become excessive.
We found some online forums specifically dealing with peoples’ real life K-1 visa experiences very current and full of helpful information regarding potential pitfalls as well as what specifially to expect during the process.
I hope this is helpful to you and good luck!

Visa Journey for marriage based immigration info to US.

Minimum wait time for K1 fiancee visa these days is ranges from 8 to 12 months. About 1 year for K3 or CR1 spouse visas. CR1 would be the better choice IMO. It costs less, and you can work pretty much as soon as you enter the US, and no need to apply for AOS after you get there, as you have to do with the K1 and K3. Which means A LOT less hassle.
