What is "Occasional Visit" to Canada by a Canadian..

Post Fri Nov 25, 2011 1:01 pm

Hi everyone, this is my first post here. Sorry if this has been discussed before, but here goes.

I am a Canadian, lived in the GTA and now am living out of Canada. Am a non-resident for tax purposes and want to keep it that way. The CRA allows 'occasional visits' to Canada for non-residents, but what is 'occasional'? Currently am planning to visit Canada twice a year, maybe for a month each time. Does anyone have any idea if that would be considered occasional?

Any thoughts or experiences in this aspect welcome! :)

The key issue is where you live now.

If you live in a treaty country, your trips to canada are essentially unlimited.

if you live in a non-treaty country, then visiting for 25% of the year regularly *could* be construed as failing to remain non-resident. It would depend on what other ties you've kept; Where and how you spend yoru time in canada also has a bearing.

So it really comes down to where you live now.
