What's the best visa route for me?

Post Tue Jan 05, 2010 6:18 pm

My fiancee (US Citizen) and I (Canadian) plan to get married in August, 2010 in Las Vegas. We are thinking to apply for the K1 (fiance) Visa but some have suggested that it is not the best way. I will take up permanent residence in the US. A permit to work there is not urgent. We want to travel accross the border, by car, without hassle, to visit my family. Ours is a simple union of two (soon to be) retirees planning to reside in the US. Thanks

Well, K1 is the "best" route for someone who knows they are marrying a US citizen living in US and knows they will be applying for permanent residency in US.

To do othrwise requires a certain amount of 'subterfuge' which, if found out can get you isolated in canada for a time.

Hello
I also plan to get a K1 visa to bring my Canadian fiance to the US for marriage. My question is, once married will she be able to travel back and forth freely? She has a home in Canada and I have a home and job in the US. Our plan was to travel back and forth but everything I read says that she would have to permanently reside in the US after marriage? Any help is greatly appreciated.

Go to visajourney.com.

It will be difficult but not im[possible for her to travel back and forth, with proper proff that she continues to truly live in Canada (job, home etc).

But it will just take one US border officer in a bad mood to deny her re-entry, and she will need to stay in canada until she gets a K-3 visa.

Hello,
I'm engaged to an Dual (Can/US) citizen and we live in Canada. We are considering moving to the US and I'm wondering what the best option is for visas or Greencard.
My occupation meets the requirements for a TN and I have a University Degree. My research has led me to believe that the TN is the easiest and fastest way.
If so, will having a TN be an issue if I decide to apply for a Greencard?
Alternatively, would it make scene to marry and apply for a greencard first? And can I obtain a TN while applying for a Green card which I read takes about 8 months?
Also, I've read about K1 visas as well and I'm not sure if that's a valid option.
Basically, I would like to choose the best option that would allow me to move to the US once(if) I receive a job offer.

You cannot get a TN once you begin the GC process.
Moreover, if you marry a US citizen and then wish to move to US, that will be considered sufiicient immigrant intent to deny entry on any status other that K visa or green card, including TN.

If you are planning to work in US but don't yet have a job offer, you should be marrying and persuing GC quickly.

visajourney.com is a better source of info on these matters.

I have recently been offered an outside sale postiion in the US. The opportunity is part of the exit strategy for the owner (a friend). The plan over the enxt few years would be to move and work in an outside sales role and over the course of the next fice to 10 years jointly purchase the business with two other employees.

I do not have a college degree, however I have 23 years expierience in sales over all. The last 11 years to present have been in the same field and product that I would be working with in the US. In fact the biggest driver to moving is the opportunity to own the business. There are no ownership opportunities at the company I am at right now.

I have done some research but still am not certain what visa would be the best. I would not be looking to immigrate and become a citizen, I could maintain my home here in Calgary (although I have also read there may be extra tax implications for rental properties). I at this point we would still like to end up retiring back in Canada. 10 - 20 yrs?

I also have the luxury of figuring this out over time with no pressure. We definitely would like to have this figured out in the next 24 months.

I would certainly appreciate comments and advice regarding this change.
