What steps? Can - USA

Post Wed Mar 26, 2008 11:46 am

Hi, I'm new here and I am not sure where to start.

I am planning on moving to the USA in 6 months. I am currently in Canada (born and raised) and my girlfriend is in the USA on a work Visa (from Australia). We are planning on getting married and I will move to the US to live with her. My current employeer (Canadian) has offered me the opportunity to work remotely for them out of the US.
What steps do I need to take to do this?

Depends what visa she's on. Certain categories allow spouses to work, some don't. Find out what she's on and check the State Dept. site and www.uscis.gov

If she's on E-3 you can get employment authorisation.

L-1 Visa Option

Post Thu Mar 27, 2008 4:45 pm

I would suggest that you consider the L-1 Corporate Transfer Visa option. To qualify for the L-1, you will need to show that you were employed in Canada for one year within the last three years with the Canadian company.

The Canadian company will need to simply establish a U.S. branch office, and subsidiary.

Canadians citizens can apply for L-1 visas at a class "A" port of entry, with a Free Trade Officer. Our law office has over 20 years of experience preparing L-1 visa cases, including 17 years of preparing L-1 cases for Canadian companies.

We can incorporate a company in any state, and assist the company with arranging for qualifying initial U.S. office space.

Do you have a T-4, evidencing full-time employment with the Canadian company?

Problem with an L-1 is that they have limited validity, an E-3 can be renewed forever. Depends on how long he intends to stay and how long she plans on being in that job.
