Who to get the TN from

Postby JonathanD » Sat Oct 17, 2009 3:52 pm

I was working on a TN for a client for about 2 years now, my contract was abruptly ended my contracting company called and asked me to head home , The Client HR director also stopped by and asked me to leave on the spot. (in a nice way though)
I felt like someone kicked me in my ***ts, however the HR informed me that both companies had some issues which made me feel much better.

2 days later i crossed the border through Sarina surrendered my i94 on the Canadian side.

Same contracting company is now sending me to another client in the US, but on their TN.

Is this possible? I won't be working for the consulting company i will be at a new client for a few months. The contracting company did tell me they asked the client to issue a TN but the client will not, and has asked the consulting company to take this matter on their own.

Either way is fine. If the contracting co. sponsors you, you only need the 1 TN regardless of which client they send you to (as long as they word it properly in the letter.

Otherwise you get one TN per each client you work at.

Please correct me if i am wrong

Canuck Technologies is pleased to offer you a position as Management Consultant. We are looking forward to you working with our clients based in USA etc etc

So this letter should talk about the work i will be doing at client site. Should i put down what kind of client the company has? they are financial firms, big banks expanding in the US buying distress small US regional banks or should i just emphasize on the client wording.

this letter will be accepted at the border correct? I am not going to be turned around asking me to get the letter from the client's, are their any gray area's i should be worried about?
The client won't give me the letter and the consulting company don't want to use any lawyer. I can if i pay up but i don't want to spend a few grand on a letter

Thanks

It does not. The only scenario that will not be acceptable is you (or your own company) getting a TN for yourself. The manner in whivch you are paid is immaterial for TN.

H1 requires employment, usually full-time.

Hey sorry to ask questions again and again but just wondering do the letter need to state who the clients will be? or just the term client is enough..................

Thanks

Yes it is legal to be sub-contracted on TN-1. The letter needs to say you will be working for the consulting company and assisting with their clients.
