wife working in Ca. seeks to live with U.S. husband in Wa.

Post Thu Feb 02, 2012 12:38 pm

I am a Ca. citizen and have been working for Canada Post for over 20yrs and currently live in Vancouver. My husband and I recently got married in B.C. He lives in Wa. state, just across the border in the U.S. My question is: Can I keep working for Ca. Post, live in the U.S. and go to work everyday in Ca.?

If possible, what type of visa would be required? How long does it take? And what are the costs associated with this. Any qualified advice is very much appreciated.

Once you have your green card, it is perfectly legal to do what you are proposing to do. The tricky thing is that it takes many months (perhaps up to a year or so) for him to sponsor you for a green card through consular processing. During that time period, you might have trouble visiting him in the USA, although you could see each other via him visiting you in Canada.

A green card is the only option since you will be living in the USA with a US citizen husband--clearly you are an intending immigrant. Commuting to Canada to work is fine since you remain a Canadian citizen.

Remember that qualified advice is only offered by qualified attorneys formally retained, usually for a fee, by a client. Even attorneys usually don't offer free advice on the internet because of the risks involved. Any thoughts people give you on here are just initial pointers, not qualified legal advice.

Edited to add: Actually I just noticed you didn't actually say that your husband is a US citizen. My comments above assume he's a US citizen. If he has some other status in the US, it would be good to clarify.

CR-1 visa!!! VJ is a great FREE site! Has everythign you need--step by step instructions, even exaples of filled out forms!! Paperwork is easy, its the waiting that sucks! CR-1 is taking anywhere form 6-12 months! But has been speeding up! Ur interview will be in Montreal!! ALL CR-1 got Montreal for the interview at the USA consulate!

Read the GUIDE at the top of that link! Even a Canada forum!

Yes there arer a few VJ members that work in Canada, but live in the USA.

Next question ur going to have:: CAn I visit the USA while under going the proicess? Simple answer is YES, but up to the USA poe officer!! Ensure one has ties to Canada, to prove your going to return to Canada!! I traveled monthly to DC with no probs, but yes, some do people get harassed more and some even get denied entry! But most on VJ have no probs!!

Do check out VJ, it is a very informative site and it is free!

Above all that is assuming ur husband is a USA citizen!!

You do NOT need a lawyer for most cases, but thats up to u! In most cases lawyers are just $$$$$$ proof readers!! You have to gather all the info and quite often fill out the forms! How do I know? I spent $2500 usd in 2004 on a lawyer---that was BEFORE I had found VJ! Yes their are times when a lawyer can be usefull!!

best of luck

FYI, yes he is a U.S. citizen. I am also wondering if his condition might be a restriction. He recently had a liver transplant and is on SSI medicaid. So, he has to stay in Wa. for another year. Otherwise we could just live in Ca. Since I have a career job at Ca. Postal Service... he does not need to fully support me in the states. Does that make a difference?

As already mentioned by FLAMES9 visajourney.com is your friend! He'll probably need a joint sponsor who theoretically able to support you. OTOH if your own situation is secure it should be fairly easy to find such a sponsor.

Would you be looking to move to Canada at some point in the future?
