wife working in U.S.

Post Sun Dec 06, 2009 6:26 pm

Hi new to the forum. My wife is working in the U.S. On a 6 month visa as a nurse. She wants to extend that to 9 months next year. My question is what happens on the Canadian end. Is that ok with the Canadian government, pension healthcare ect.? And I wil be retired next year can I stay with her or will I have to return after the 6 months? Thanks for any info.

If your wife has immigration status as a Nurse, then that has really nothing to do with Canada as she would contribute to U.S. payroll taxes rather than Canadian. If you are retired in Canada, you may enter on B-2 Status for as long as 6 months. Normally the duration granted is six months but is usually at the discretion of the inspecting officer.

Normally on B-2, one must display sufficient funds to support oneself while in the U.S. and explicit ties to Canada may be requested for example in the form of an apartment lease. Sometimes though due to ignorance, they don't even bother so it is a better idea to come prepared.

You could return to Canada after 6 months on B-2 and than request a new B-2 at the port of entry if desired.

depending on which province you're from, if your wife is out of Canada for more than the time allowed by the provincial health plan, she may run into difficulties when she returns after her 9 months stint in the US.

She needs to contact the provincial health office to request an extension, so that they do not cancel her insurance.

Since your spouse is in US on a working status (likely TN), you are entitled to a depaendant status, with the same validity and duration as hers. So, while you can enter on B2, its simpler to get a TD at the border, one time. Since TN and TD allows living in US, no need to prove anything about Cdn ties. Forget B2 in your case, that is for tourists.

As to her situation, if she is going to live in US 9 months, she might as well commit and find full-time work there, as reba says, after 6 months, her Prov healthcare is at risk. You could both move and he would avoid Cdn tax altogether.

Thanks. yes she has a tn visa. Also what should we expect when she files her income tax. What does the Canadian government expect. Is it a percentage of what she makes down here/ This is all new to us. We are from B.C. and own a house here. Thanks
